1. The subject cited HCF is a Non-bedded Government Hospital in the name and style of M/s Mini PHC Nagar Phillaur, Tehsil Phillaur Distt- Jalandhar.
2. Now, the HCF has applied for fresh authorization under BMW (Management & Handling) Rules, 2016 for Hospital only.
3. No action is pending against the concerned healthcare facilities for violation of Bio/Medical Waste Management Rules, 2016, Water (Prevention & Control of Pollution) Act, 1974 & Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986.
4. The HCF has made agreement with M/s Meridian Milieu Care Private Limited, Village Bir Pind, Distt. Jalandhar for lifting of its Bio-medical Waste, valid upto 24.03.2026.
5. The Bio-Medical Waste is being lifted by CBWTF and the HCF has maintained the record of the same as the HCF has submitted the manifest slips. From the record, it is clear that the HCF is regularly lifting its Bio-Medical waste lifted to CBWTF.
6. HCF has not deposited one- Time authorization fee.
7. Further as per Board letter No. 23951-53 dated 05.10.2023 in which it is mentioned that the Managing Director, Punjab Health Systems Corporation (PHSC) has informed he Department of Science, Technology & Environment, Punjab that the consent fee is required to be deposited with the consent applications, however, these funds are to be transferred to one department to another within Government and requested to issue/continue the renewal of BMW authorization along with the consent under the water Act, 1974 and Air Act, 1981 for all HCF’s in Punjab.
The request made by PHSC matter has been considered by the Government and directed the Board that “ਪੰਜਾਬ ਵਿੱਚ Public Healthcare facilities ਵਲੋਂ ਫੀਸ ਜਮ੍ਹਾਂ ਕਰਵਾਉਣ ਵਿਚ ਦੇਰੀ ਕਾਰਨ authorization ਨਾ ਰੋਕੀ ਜਾਵੇ ਅਤੇ, ਇਨ੍ਹਾਂ Public Healthcare facilities ਨੂੰ ਇਸ ਸ਼ਰਤ ਤੇ authorization ਦਿੱਤੀ ਜਾਵੇ ਕਿ ਇਨ੍ਹਾਂ HCF ਵਲੋਂ ਫੰਡ ਉਪਲੱਬਧ ਹੋਣ ਉਪਰੰਤ ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਰੋਕਥਾਮ ਬੋਰਡ ਵਿਚ ਜਮ੍ਹਾਂ ਕਰਵਾਏ ਜਾਣਗੇ ।“
You are, therefore, requested to strictly ensure the compliance of instructions received from the Government and not to stop / delay the grant / renewal of authorization under the BMW Rules, 2016 and 'consents to operate' under the Water Act, 1974 & the Air Act, 1981 to HCF of Public Sector due to non-deposit of requisite authorization / consent fee. A condition be imposed in such cases that HCF shall deposit the authorization / consent fee on availability of funds.
In view of the above, it is recommended that the HCF may be granted the one-time authorization with usual conditions as per the Board policy and with following special condition: -
1. The HCF shall deposit one-time authorization fee on availability of funds.
2. The HCF shall adopt the proper color-coding as per Bio-medical Waste Management Rules, 2016 & segregating its Bio-medical Waste as per Bio-medical Waste Management Rules, 2016.
3. The HCF will renew its agreement with concerned CBWTF on expiry of the same.
4. The HCF shall apply for the revised authorization as per the Board's policy, if at any later stage, the HCF adds patient beds or dental chairs in its premises.
