File Note: Subject: Application for obtaining fresh authorization under the provision of Bio-Medical Waste Management Rules, 2016-M/s Bhagwati Clinic, Aery Mill Road, Mandi Gobindgarh, Distt. Fatehgarh Sahib. It is intimated that the clinic was granted authorization under the provision of Bio-Medical Waste Management Rules, 2016 through BMW/Fresh/FGS/2019/10538567 dated 19/07/2019 valid upto 31/12/2019 with 01 no. of bed capacity. The HCF has deposited Rs. 1000/- vide UTR no. BARBR24200043195 dated 18/07/2024 as required vide Deptt. of Science Technology and Environment, Govt. of Punjab notification no. 485954 dated 06.01.2023. Now, the application of the HCF was scrutinized and as per details/documents submitted, the HCF is a Clinic & does not have any bed (admission) capacity as per agreement/certificate submitted by the HCF. The HCF has also submitted agreement signed with M/s Rainbow Environments (P) Ltd., Mohali on 09/07/2022 which is valid upto 08/07/2025 for 0 bed capacity. It is pertinent to mention here that as per latest Board's Office Order no. EPA/2018/No. 04 dated 10/4/2018, the authorization (fresh/renewal) under the Bio-Medical Waste Management Rules, 2016 applied by the healthcare facilities upto 10 beds/ dental chairs will be granted by the concerned Regional Office within 7 days of receipt of complete application without making inspection of those healthcare facilities. However, the concerned Regional Office shall ensure that no action is pending against the concerned health care facility for violation of the Bio-Medical Waste Management Rules, 2016, Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 Environment (Protection) Act, 1986 and various rules made there-under. It is intimated that Board has issued Board’s order no. 379 dated 21/10/2023, has decided that the HCF upto 30 beds which are discharging there liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plant have been installed, shall be granted consents/ authorization by Punjab Pollution Control Board without installation of individual ETPs, as an interim arrangements/ measures, subject to condition that the HCF shall ensure to comply with the effluent standards as notified by Ministry of Environment, Forest and Climate Change (MoEF&CC) under Bio-medical Waste Management Rules, 2016, amended upto date and subsequent amendments if any. In the subject cited case, the HCF has not installed any ETP. However, it is connected to terminal STP of Mandi Gobindgarh. Keeping in view of the above, it is recommended that one-time authorization under Bio Medical Waste (Management & Handling) Rules, 2016 may be granted to the HCF as per policy of the Board with special conditions as follows: 1. The Lab shall renew its Agreement with Common Bio Medical Treatment Facility at the earliest before its expiry & submit the same in this office. 2. The HCF will apply for fresh authorization under Bio-Medical Waste Management Rules, 2016 / Consent to Operate under Water (Prevention and Control of Pollution) Act, 1974 amended in 1988 and Air (Prevention & Control of Pollution) Act, 1981, amended in 1987, if it becomes a bedded hospital. 3. The HCF comply with the Bio-Medical Waste (Management & Handling) Rules, 2016, in true letter & spirit.
