It is submitted that the HCF has applied for obtaining fresh authorization under the Bio-Medical Waste Management Rules, 2016 through OCMMS with requisite documents for operation of Laboratory. The HCF has deposited one time authorization fee of Rs 1000 vide UTR / Ref. No. HS92418749477226 dated 05.07.2024, which is adequate.
The HCF has submitted that the liquid waste is treated with 1-2% sodium hypochlorite solution. The HCF has submitted copy of an agreement with common facility namely M/s Meridican Milieu Care Pvt. Ltd., Village Bir Pind, Tehsil Nakodar, District Jalandhar authorized by the Board, which has under taken the liability of collection, transportation and treatment / disposal of Bio-Medical Waste generating from the hospital. The agreement made with facility was valid upto 17.07.2026.
It is pertinent to mention here that as per Board's office order no. EPA/2020/04 dated 09/06/2020, it was decided as under:
'All the dental clinics having one dental chair as well as the other clinics having one examination table shall be considered as non-bedded Health Care Facility as far as applicability of the BMW Rules, 2016 is concerned. However such HCEs shall submit an undertaking to the effect that they are not having facility to admit and to keep the patient for a day under observation, at the time of obtaining authorization from the Board as required under the provisions of the the Bio Medical Waste Management Rules, 2016.'
Further, as per Board's office order no. EPA/2018/01 dated 03/01/2018. If the Health Care Facility is non-bedded, it will be granted one time authorization under BMW Rules, 2016 with the condition that the HCF will apply for fresh authorization if it becomes a bedded hospital
Also, as per Board's office order no. EPA/2018/04 dated 10/04/2018, the authorization (Fresh / Renewal) under the Bio Medical Waste Management Rules. 2016 applied by the Health Care Facilities upto 20 beds / Dental chairs will be granted by the concerned Regional office within 07 days of receipt of complete application without making inspection of Health Care Facilities.
Moreover, as per the office order no. EPA/2017/No. 5261-86 dated 15/12/2017 the competency of upto 50 beds HCEs and Labs and Blood Banks, Pathological Lab, Veterinary Institutions / Animal House etc lies with the Environmental Engineer of the Regional Office's.
Keeping in view of above, may if approved, one time authorization may be granted to the HCF for operation of Laboratory, subject to the suitable conditions and following specific conditions:-
1. The authorization for management and handling of Bio-Medical Waste shall not be construed as a permission to operate the Health Care Facility in a non-designated area and the HCF shall be responsible for obtaining permission / clearances as required under the law from different departments.
2. The occupier of the Health care establishment shall take all precautionary steps to avoid leakage/spillage of Bio-Medical Waste from the storage area, the storage area shall be properly fenced/protected with caution sign boards.
3. The occupier of Health care establishment shall ensure that the Bio-Medical Waste is handled, only by qualified/trained personals in the field.
4. The authorization is subject to the general conditions imposed and also to such conditions as may be specified under the Rules time to time in force under the provisions of Environment (protection) Act, 1986.
5. The hospital will comply with the Bio-Medical Waste Management Rules, 2016.
6. The person authorized shall not rent, lend, sell, transfer or otherwise transfer the Bio medical waste without obtaining prior permission of the prescribed authority.
7. Any unauthorized change in personal, equipment or working conditions as mentioned in the application by the person authorized shall constitute a breach of his authorization.
8. It is the duty of the authorized person to take permission of the prescribed authority to close down the facility and such other terms and conditions may be stipulated by the prescribed authority.
9. The authorization is granted on the basis that the HCF does not have facility to admit and keep the patient for a day under observation. If in case of so, application for fresh authorization be applied to the Board. Also, the HCF will apply for fresh authorization if it becomes bedded.
10. The HCF shall apply for obtaining Consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, within one week.
11. The HCF will treat the chemical liquid waste generated from its premises with 1-2 % hypochlorite solution.
