It is submitted that the HCF has applied for grant of authorization under the provisions of Bio-Medical Waste Management Rules, 2016 for generation, collection, storage and disposal of Bio Medical Waste generated from non bedded facility. It has submitted location plan and copy of agreement with Common Bio Medical Waste Carrying facility. The HCF has entered into an agreement with CBWTF. The HCF has submitted Bed capacity certificate mentioning that, the HCF has not provided any bed. No action is pending against the HCF under Bio-Medical Waste Management Rules, 2016. It is pertinent to mention here that a meeting of Core Committee was taken by the Hon’ble Chairman, PPCB on 19.03.2018 in the Committee Room, Head Office, Patiala and proceedings of the same have been received in this office through e-mail. In the said meeting, with regard to grant of authorizations under BMW Rules, 2016 to the HCEs, it was decided as under: i) The Healthcare facilities upto 20 beds/ dental chairs, the documents to be obtained for getting authorization under the BMW Rules should be bare minimum i.e. location plan, agreement with CBWTF, self-declaration (To be specified by PPCB), copy of last month's manifests etc. ii) The fresh/renewal applications of HCFs' be processed online within one week without any prior inspection subject to submission of requisite documents by the HCFs'. The Regional Office will also ensure that no action regarding violation of the provisions of BMW Rules is pending against the HCF.
Further, as per Department of Science, Technology & Environment, Govt. of Punjab’s notification no. STE-STEB010/213/2020-STE(5/4)/485954 dated 06.01.2023, the HCFs are now be required to deposit fee to obtain authorization under BMW Rules, 2016. Accordingly the HCF has deposited one time fee i.e. Rs. 1000/- as BMW Authorization fee vide UTR no. N197243153015540 dated 15.07.2024.
Further, 3rd Core Committee Meeting was held on 25.09.2019, wherein the competent authority has decided as under :-
All the dental clinics having a dental chair as well as the other clinics having one examination table shall be considered as Non-Bedded Health Care Facilities subject to the condition that they have to submit an undertaking to the effect that “They are not having any facility to admit and keep the patient for a day under observation” while obtaining authorization from the Board as required under the provisions of BMW Rules, 2016.
The HCF has made MOU with CBWTF for non bedded facility.
Keeping above in view, it is recommended that one time authorization under Bio-Medical Waste Management Rules, 2016 may be granted to the HCF with suitable conditions and specific conditions as under: -
1. The HCF shall only provide examination table for daycare purpose.
2. The HCF shall not provide any bed.
3. The HCF shall comply with the decisions of 3rd Core Committee Meeting held on 25.09.2019.
