Sub: Proceedings of the personal hearing given before the Chairman of the Board on 23.07.2024 w.r.t. show cause notice for refusal of authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 to M/s Garg Acrylics Ltd. (Garment Division), Kanganwal Road, VPO Jugiana, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted authorization vide no. HWM/renew/LDH2/2018/ 8127878 dated 11.12.2018 expired on 31/03/2023 for Category 35.3 @ 0.6 Ton/Annum, Category 33.1 @ 36 number/Annum, Category 5.1 @ 0.04 KL/Annum.
The industry has now applied for renewal of authorization under Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016 for Category 35.3 @ 0.6 Ton/Annum, Category 33.1 @ 36 number/Annum, Category 5.1 @ 0.04 KL/Annum.
The application of the industry has been perused and following observations has been made:-
1. The industry has not intimated the status of total generation / lifting of hazardous waste from 2018 to 2023 and from 2023 to 2024 of hazardous waste category 35.3.
2. The industry has not intimated the status of total generation/ lifting of hazardous waste from 2018 to 2023 and from 2023 to 2024 of hazardous waste category 33.1.
3. The industry has not intimated the status of total generation / lifting of hazardous waste from 2018 to 2023 and from 2023 to 2024 of hazardous waste category 5.1.
4. The industry has not intimated the quantity of hazardous waste of category 35.3 lying stored in the premises.
5. The industry has failed to made fresh agreement for lifting of hazardous waste category 35.1.
6. The industry has not submitted compliance report of conditions of previous authorization granted under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 in annotated form.
In view of above, the industry was issued show cause notice for refusal of authorization under the Hazardous and other Waste Rules, 2016 with hearing before Chairman of the Board on 23.07.2024.
Sh. Anish Bansal, Vice President of the industry attended the hearing and submitted a written reply, which was taken on record. He submitted that the industry is a garment unit and has applied for renewal of authorization under hazardous waste. The industry has submitted form-iv in prescribed format which mentions the total generation / lifting of hazardous waste category 35.3, 33.1 and 5.1. The unit is a garment unit and the sludge generated from the washing section is less in quantity for which they have already made agreement with the disposal facility. The record of hazardous waste generation and lifting are also enclosed.
It is further submitted that the record of the industry w.r.t. hazardous waste was checked and found that the industry has not lifted the sludge since long time.
After hearing the industry, officers of the Board and considering material facts on record, the Chairman of the Board decided as under:
1. Another opportunity of personal hearing be afforded to the industry.
2. The industry shall store all the categories of hazardous waste in environmentally sound manner, maintain proper record of generation and disposal of hazardous wastes.
3. The Senior Environmental Engineer, Zonal Office-1, Ludhiana shall within 03 days visit the industry to verify the submissions made by industry and submit its flash report well before next date of hearing.
