It is intimated that the industry was issued notice to issue directions u/s 5 of the Environment (Protection) Act, 1986 with hearing before Chairman of the Board on 23.07.2024.
Sh. Karun Bhalla, Partner of the industry attended the hearing and submitted a written reply, which was taken on record. He submitted that the industry is engaged in dyeing of polyester/PC fabric and connected outlet with CETP (40 MLD). Now, the industry is generating only hazardous waste of category 5.1 (spent oil of D.G. set) and they have applied for authorization under Hazardous & Other Waste (Management & Transboundary Movement) Rules, 2016 for hazardous waste of category 5.1. The industry is maintaining hazardous waste properly in hazardous waste room and now made MOU with all the authorized person for lifting of hazardous waste and they are maintaining record of hazardous waste properly and regularly. The industry has lifted all previous quantity of hazardous waste of category 35.3 of 1.5 Ton (1510 Kg) to TSDF Nimbua vide manifest no. 49883 dated 10.06.2024.
After hearing the industry, officers of the Board and considering material facts on record, the Chairman of the Board decided as under:
1. The industry shall make proper arrangements for collection, storage and disposal of hazardous waste of category 5.1 and 33.1 under Hazardous & Other Wastes (Management Handling & Transboundary Movement) Rules, 2016.
2. The industry shall maintain proper record of storage and lifting of hazardous waste of category 5.1 and 33.1 under Hazardous & Other Wastes (Management Handling & Transboundary Movement) Rules, 2016.
3. The Environmental Engineer, Regional Office-1, Ludhiana shall verify submissions made by the industry and process authorization application on merits.
The proceedings of same were sent to Competent Authority for approval and are under process.
Now, the industry has applied for obtaining fresh authorization under Hazardous and Other Wastes Rules, 2016 for generation, collection, storage & disposal of hazardous waste Cat. no. 5.1 (Used or spent oil) @ 0.1 KL/Annum, 31.1 @ 30 No.s/Annum alongwith requisite documents through OCMMS. Further, the industry has entered into an agreement with M/s Satkar Oil Co., Ludhiana for shifting of its hazardous waste on 23.04.2024 for hazardous waste category no. 5.1 and with M/s J.S. Plastic, Chandigarh Road, Ludhiana on 05.07.2024 for category no. 33.1.
Accordingly, the industry was visited by RO on 12/07/2024 and it was reported as under: 1. The industry was in operation during visit. 2. The industry has installed 8 no. soft flow machines (1 no. of capacity 1000 Kgs, 2 no. of capacity 450 Kgs, 4 no. of capacity 300 Kgs and 1 no. of capacity 250 Kgs). 3. The industry has also installed 4 no. washing machines (3 no. of capacity 75 Kgs & 1 no. of capacity 10 Kgs). 4. It has disposed off its ETP sludge i.e. hazardous waste of category 35.3 @ 1510 kgs vide manifest no. 49883 dated 10.06.2024 to TSDF Nimbuan. 5. The industry has started maintaining record of hazardous waste. 6. The industry has installed 1 no. DG set of capacity 350 KVA which is with canopy and adequate stack height. 7. Category 5.1 (SPENT Oil) It has signed an agreement with M/s Satkar Oil Co., Ludhiana for disposal of hazardous waste of category 5.1. There is no storage of spent oil as service of DG set is pending. CAT. 33.1 (Empty Container) It has signed an agreement with M/s J.S. Plastic, Chandigarh Road, Ludhiana for disposal of hazardous waste of category 33.1. Current storage of empty containers is 18 numbers.
In view of the above, it is recommended that authorization for collection, storage & disposal of hazardous wastes for waste Cat. no. 5.1 (Used or spent oil) @ 0.1 KL/Annum and 31.1 @ 30 No.s/Annum under Hazardous & Other Wastes (Management Transboundary Movement) Rules, 2016, may be granted to the industry upto 30/06/2029 with suitable conditions, please.
