It is submitted that the HCF applied for fresh authorization under the provisions of the Bio-Medical Waste Management Rules, 2016 for dental clinic having 1 chair capacity alongwith requisite documents.
As per H.O.Patiala Office Order No. EPA/2018/No. 04 dated 10.04.2018 the authorization (fresh/renewal) under the Bio-Medical Waste Management Rules, 2016 applied by the healthcare facilities upto 20 beds/dental chairs will be granted by the concerned Regional Office within 7 days of receipt of complete application without making inspection of those healthcare facilities. However, the concerned Regional Office shall ensure that no action is pending against the concerned health care facility for violation of the Bio-Medical Waste Management Rules, 2016, Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and various rules made there-under.
In light of above office orders, the inspection is not required as the HCF having 1 no. dental chair. The brief detail of the case applied by the healthcare facility is as under:-
1. The HCF has submitted the Location Plan of the HCF.
2. The HCF has made an agreement with M/s Rainbow Environments Pvt. Ltd., Village Balyali, Tehsil Kharar valid upto 20.06.2027 for 1 no. dental chair.
3. As per record of this office, no action is pending against the health care facility for violation of the (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986.
It is intimated that Board has issued partial modification to earlier Board’s order no. 468 dated 31.08.2021, vide its office order no. 601 dated 16.12.2021 has decided that the HCF upto 50 beds which are discharging there liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plant have been installed, shall be granted consents/ authorization by Punjab Pollution Control Board without installation of individual ETPs, as an interim arrangements/ measures, subject to condition that the HCF shall ensure to comply with the effluent standards as notified and Bio-medical Waste Management Rules, 2016, amended upto date and subsequent amendments if any. However, no specific period mentioned in the said orders.
Further, the HCF has deposited Rs. 1000/- (one year fee) vide UTR. No. N204243163791458 dated 22.07.2024 under Bio-Medical Waste Management Rules, 2016 fee as per Board’s office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023.
In view of above, if may approved, one time authorization under the Bio-Medical Waste Management Rules, 2016 may be granted to the HCF subject to the suitable conditions and following additional conditions as under:-
1. This BMW authorization is valid for 1 dental chair only. The HCF will apply for fresh authorization if it increases its capacity.
2. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same and intimate to the Board.
3. The authorization is valid for category and quantity of bio medical waste as mentioned in the certificate. If in case the HCF starts generating bio medical waste more than authorized quantity for any category it shall obtain fresh authorization from the Board.
4. The HCF will use 1-2% sodium hypo-chlorite solution for disinfection of chemical liquid waste generated in the HCF and keep the record of the consumption of the Sodium hypochlorite solution.
5. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
6. The HCF will maintain proper record of generation and lifting of bio-medical waste.
7. There is no claim of continuation of HCF in present premises on the basis of this authorization. The HCF has to comply with the zoning regulation of master plan & to be shifted from the site as and when asked by the Govt./PPCB/ or any concerned Govt. agency.
8. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis.
9. The HCF shall obtain other statutory approvals required from other departments, if any.
10. The authorization is granted on the basis of declaration given by the HCF and in case declaration given by the HCF is found to be false under any circumstances, the authorization granted to the HCF may be deemed to be considered as cancelled.
