It is submitted that the unit is a bedded HCF and has applied for obtaining authorization under the Bio-Medical Waste Management Rules, 2016 for 20 beds capacity.
Further, the Board vide its office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023, has notified authorization fee for HCFs. In this case, the HCF falls in the category of 11-30 beds capacity and accordingly, the HCF has deposited fee of Rs. 2,000/- vide office R. No. UCBAH24197222139 dated 15/07/2024 under the provisions of BMW Rules, 2016, which is valid up to 30/06/2025.
The brief detail of the case applied by the healthcare facility is as under: -
1. The HCF has made an agreement with M/s Medicare Environmental Management Pvt. Ltd., Ludhiana which is valid upto 30/06/2029 for 20 bed capacity.
2. The HCF has submitted copy of manifests of lifting of waste by CBWTF operators.
3. The HCF has submitted Self Declaration regarding its bed capacity and its operation.
4. The HCF has submitted location plan.
The HCF is complying with the provisions of BMW Rules, 2016.
The HCF was visited by the officer of this office on 18.01.2024 and it was observed as under:-
1. The HCF is newly established and has provided 20 bedded hospital.
2. The HCF has provided the color coded bin and segregating the bio medical waste as per BMW Rules, 2016.
3. The liquid waste generated by the HCF is being treated with sodium hypo chloride solution.
4. The HCF is lifting its bio medical waste to the CBWTF.
As per the latest Office Order of the Board vide no. 379 dated 23/10/2023,
“it has been decided that HCFs upto 30 beds capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal STPs have been installed shall be granted consents to operate and Authorization without installing individual ETPs as an interim arrangement, subject to the condition that HCF shall comply with the effluent standards prescribed by the MOEF&CC under the Bio Medial Waste Management Rules, 2016 as amended from time to time."
In the present case, the HCF is located in City Sunam, where the terminal STP has already been installed and the same is in operation.
As per record of this office, no action is pending against the health care facility.
Keeping in view of above, if approved, the HCF may be granted authorization upto 30.06.2025 for 20 beds under Bio-Medical Waste Management Rules, 2016 with suitable conditions and with special conditions that:
1. This BMW authorization is valid for 20 Beds only. HCF will apply for fresh authorization if it increases its bed capacity.
2. The HCF will apply for consents of the Board under Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and under Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 within one month.
3. The HCF will comply with the provisions of BMW Rules, 2016 in true letter & spirit.
4. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same.
5. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
6. The HCF will maintain proper record of generation and lifting of bio-medical waste.
7. HCF shall comply with the effluent standards prescribed by the MOEF&CC under the Bio Medial Waste Management Rules, 2016 as amended from time to time
8. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste.
9. The HCF shall obtain other statutory approvals required from other departments, if any.
