File Note: It is intimated that the industry is medium scale orange category induction furnace unit was granted authorization under the provision of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 through vide no. HWM/FGS/2016/3897631 dated 01/04/2016 valid upto 30/06/2020 for Generation, Collection, Storage & Disposal of Cat. 35.1 @ 0.60 TPA. It is further intimated that the industry was granted consent to operate under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through vide no. CTOW/Renewal/FGS/2021/17502821 dated 21/12/2021 and CTOA/Renewal/FGS/2021/17502820 dated 21/12/2021 both are valid upto 30/09/2026 for manufacturing of Automobiles Parts, Medical Equipment's & Pipe Fitting etc. @ 1.6 MT/day. The industry was issued show cause notice for refusal of authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 before the Chief Environmental Engineer(B), on 28/04/2022 at Patiala and proceeding of the same is as under: 1. The renewal of authorization applied by the industry be refused. 2. The industry shall not dispose off its hazardous waste to TSDF, Nimbua and it will make agreement within 07 days with the authorized hazardous waste re-processor for lifting of hazardous waste Cat. 35.1 of Schedule-1. 3. The Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry immediately to verify the submission made by it during hearing, advice the industry to apply for revised authorization as per actual generation of hazardous waste and submit report within a week. 4. The industry shall apply for revised authorization for actual generation of hazardous waste Cat. 35.1 of Schedule-I within 10 days. 5. It was made clear to the industry, in case the industry was found violating the provision of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 strict action will be initiated including imposition of Environment Compensation against the industry without affording any further opportunity/personal hearing. Now the industry has applied for fresh authorization under the provision of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for Generation, Collection, Storage & Disposal of Cat. 35.1 @ 0.60 TPA and Cat. 5.1 @ 0.030 KL/Annum under orange category with requisite documents. To verify the contents, the industry was visited by the AEE of this office on 03/08/2024 During the visit, it was observed as under: 1. The industry was in operation during the visit. 2. The industry has provided separate top hoods followed by common APCD i.e. Bag filter with both the induction furnaces of capacity 300 Kg/heat and 150 Kg/heat, as per the design of PSCST, Chandigarh. 3. The industry made an agreement for lifting of its hazardous waste Cat. 35.1 with M/s Nimbua Greenfield Limited, Village Nimbua, Tehsil Dera Bassi, Distt. Mohali and Cat. 5.1 with M/s BRS Lubricants, Focal Point, Mandi Gobindgarh. 4. The industry has lifted its hazardous waste of Cat. 35.1 @ 0.15 MT through vide no. 45075 dated 29/08/2023 to M/s Re Sustainability Limited (Nimbua Greenfield Limited), Dera Bassi, Dist. Mohali. 5. The industry has provided impervious storage room storage of hazardous waste. The capacity of storage room is sufficient to store hazardous waste for 2-3 years. 6. No trade effluent will be generated in the industrial process. Domestic effluent will be discharged onto land for plantation through septic tank. 7. Presently, approx. 0.068 Tons is lying stored in storage facility provided within the premises. 8. The industry has installed 1 no. DG set of capacity 150 KVA, which is equipped with canopy and stack of adequate height. 9. The industry has already provided danger sign on storage room & Environmental data Board near the main gate. In view of above, if approved it is recommended that the fresh authorization under the provision of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for Generation, Collection, Storage & Disposal of Cat. 35.1 @ 0.60 TPA and Cat. 5.1 @ 0.030 KL/Annum may be granted upto 30/09/2026 (as per consent validity) with suitable conditions and with special conditions: 1. The industry shall dispose off its Hazardous waste to the authorized recycler /re-processor having valid Registration Certificate-cum-Pass Book from Punjab Pollution Control Board and valid authorization of the Board under the said Rules and 'consents to operate' under the Water Act, 1974 and the Air Act, 1981. 2. The industry shall apply for authorization before the expiry of previous authorization of Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. 3. The industry shall handle the Hazardous Waste(s) strictly in accordance with the provisions of the Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 and guidelines issued by Central Pollution Control Board / Ministry of Environment & Forests and Climate Change, New Delhi. 4. The occupier/operator of a facility shall send annual returns to the Board in form-4 on or before 30th day of the june following to the financial year to which that return relates. 5. The Authorized person shall report, about the accident which occurs at the hazardous waste storage/treatment site immediately to the Board. 6. An occupier who is generating hazardous waste shall store his waste category wise on site in environmentally sound manner till its treatment. 7. An occupier /generator shall not store hazardous wastes in open ground. It must be stored in an isolated site away from plant operational area. 8. The storage tank/container of the hazardous wastes should be in good condition and made of (or lined with) an appropriate material which does not react with the waste contained in it and can withstand the physical and environment conditions during storage and handling. 9. The occupier generating hazardous waste shall provide the required safety devices like safety mask, goggles, hand-gloves, gum boots etc. to the workers for handling the hazardous waste. The occupier shall impart training to the personnel/workers for handling and storage of hazardous wastes. 10. The occupier shall be responsible for any damage of life/or property during storage of his waste and will obtain Public Liability Insurance, wherever applicable.
