Earlier the industry has obtained authorization under HWM rules, 2016 for generation, collection, storage & disposal of HW category 5.1- Used oil @ 1.5 TPA; 21.1- Process wastes, residues and sludges @ 3 TPA, 35.3 Cat@6TPA of Schedule-I under HWM Rules, 2016 vide no. HWM/renew/BTI/2019/9524835 dated 8.8.2019 valid upto 31.3.2024
Thereafter the Personal hearing was given to M/s Hindustan Petroleum Corporation Ltd., LPG Bottling Plant, Village PhuloKhari, Tehsil Talwandi Sabo, Bathinda before revocation of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 before the Chairman of the Board on 07.06.2024 wherein it was decided that
1. 'Consents to operate' under the Water Act, 1974 & Air Act, 1981 granted to the industry be revoked and the new lessee of the M/s HPCL shall apply for obtaining consents to operate of the Board under the said Acts, within 07 days..................
2. Environmental Engineer, Regional Office, Bathinda shall visit the industry after 07 days, carry out re-sampling, verify the compliance(s) at site and process the applications to be applied by new lessee of the M/s HPCL under the Water Act, 1974 & Air Act, 1981, on merits.
Accordingly the case applied by the industry was returned.
Now, the industry has applied for authorization under the Hazardous Waste (Management, Handling and Transboundary Movement) Rules, 2016 for generation, collection, storage & disposal of HW category 5.1- Used oil; 21.1- Process wastes, residues and sludges; 35.3- Chemical sludge from waste water treatment and 33.1- Empty barrels/containers/liners contaminated with hazardous chemicals /wastes of schedule-I under HWM Rules, 2016.
The industry was visited by AEE of this office on 12.8.2024 and it was observed as under: -
1. The industry was in operation during visit.
2. The industry has provided a display board indicating environmental data at the main gate of the industry.
3. The industry has provided a hazardous waste storage facility of size 6’x6'x6' with lock & key arrangement & covered from top to avoid any entry of rain water and concrete flooring has been provided in the hazardous waste storage shed.
4. 27 ltr Hazardous waste of category 5.1 was stored in room in MS drum & 788kg of HW of cat 21.1 was found stored in HDPE bags & 2323 kg of HW of cat 34.3 was lying stored in the industry.
5. The industry has lastly lifted HW cat 35.3 @4190 KL to Shree Cement Limited, Beawar vide manifest no. 005 dated 7..4.2021; HW of cat 21.1 @ 2860 kg vide no. 20 dated 16.4.2021, HW of cat 21.1 @ 3010 kg vide no. 62 dated 6.6.2022, HW of cat 21.1 @ 2000 kg vide no. 66 dated 21.5.2023 to M/s Eco Management and Protection Pvt. Ltd., Bhiwandi and HW cat 5.1 to M/s New lubri Sales India Private India Limited @1390 tonne vide manifest no. 006 dated 4.7.2021; HW cat 33.1 to M/s Eco Management and Protection Pvt. Ltd., Bhiwandi @3 no vide manifest no. 64 dated 21.5.2023.

As per the earlier record submitted - The HW of 33.1 category has been sent back to the paint dealer (M/s Kirti Associates, Jalandhar) as per the industry however now the industry submitted that they have started to lift the HW 33.1 to the re-processor.
6. The industry has lastly lifted HW cat 35.3 @4190 KL to Shree cement limited, Beawar vide manifest no. 005 dated 7..4.2021; HW of cat 21.1 @ 2860 kg vide no. 20 dated 16.4.2021, HW of cat 21.1 @ 3010 kg vide no. 62 dated 6.6.2022, HW of cat 21.1 @ 2000 kg vide no. 66 dated 21.5.2023 @2200kg vide dated 17.6.2024 to M/s Eco Management and protection pvt ltd bhiwandi and HW cat 5.1 to M/s New lubri Sales India Private India Limited @1390 tonne vide manifest no. 006 dated 4.7.2021, 500 ltr to M/s Indian Petro Chemical Harayana vide dated 17.6.2024 ; HW cat 33.1 to M/s Eco Management and protection pvt ltd bhiwandi @3 no vide manifest no. 64 dated 21.5.2023, @100Kg vide manifest no. 119 dated 17.6.2023.
7. As per data available all the industries are registered HW recyclers/ utilizer units except for M/s Kirti Associates, Jalandhar which is dealer of paint. The industry informed that they were not having knowledge about it.
From above it is clear that the industry is not complying with the provisions of HWM Rules, 2016
In view of above, it is recommended that industry may be issued SCN for refusal of authorization under the provisions of HWM rules, 2016
