Sub: Proceeding of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 23.08.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and show cause notice for refusal of authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 to M/s Inderjit Marwaha Autos Pvt. Ltd., Dhandari Khurd, G.T Road, Ludhiana.

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the workshop is a small scale orange category unit and the workshop has applied for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974
The industry was visited by officers of the Board on 09.08.2024 and it was observed as under:-
1. The workshop was in operation during the visit and engaged in the process of servicing and washing of cars.
2. The workshop is not re-using its whole effluent in washing area, Hence, the claim of the workshop to re-use its whole treated in washing area is not correct, so the possibility to dispose off the trade effluent through unauthorized mode of disposal cannot be ruled out.
3. The workshop has planted small plants in appox. 1500 sq. ft. area to dispose off the effluent, which is not as per Karnal based technology. The above said area is inadequate, hence, the possibility to dispose off the domestic effluent in an unauthorized mode cannot be ruled out.
4. The workshop has not submitted the dimensional drawing of HW storage room.
5. The industry has not submitted the copy of agreement for disposal of Hazardous Waste of Category No. 5.1.
6. The workshop has not provided the Environmental Data Board provided at the Main Gate of the workshop.
7. The industry has not provided the Danger sign Board outside the hazardous waste storage room. Other scrap items were also observed inside the Hazardous Waste Storage room
The industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 with hearing before the Senior Environmental Engineer of the Board on 23.08.2024.
Sh. Maninder Singh, HR Manager of the industry attended the hearing and submitted written reply which has been taken on record. He submitted that the workshop is engaged in the process of servicing and washing of cars and they have installed proper ETP plant for treatment of effluent arising from washing process which gives 100% reusable treated water for washing purpose. The industry has installed water meter at source of fresh water and outlet of ETP connected with washing area. The industry is maintaining the record regarding operation of ETP and as per record maintained for the month of July 2024, the water consumption is 277.2 KL and effluent re-used in the washing process is 251.3 KL after evaporation losses of 27 KL in the entire month. The plantation area (170 Sq. Yd.) is sufficient for discharge of domestic effluent after treatment through STP. They have now developed plantation area as per Karnal technology. They are 100% committed that they are using plantation area only for disposal of waste water through STP only.
They have submitted dimensional drawing of hazardous waste room and copy of agreement of category no. 5.1. The Environmental data Board has been ordered and will be placed soon. The hazardous waste room is now properly in place and signage boards are also pasted as the instruction of PPCB.
After hearing the industry, officer of the Board and considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall operate ETP regularly and efficiently and maintain record regarding operation of ETP, water consumption and effluent re-used in the washing process.
2. The industry shall re-use the entire treated trade effluent generating from washing process and shall discharge only domestic effluent onto land for plantation.
3. The industry shall develop plantation area as per Karnal Technology for disposal of domestic effluent.
4. The industry shall store the hazardous waste properly in environmentally sound manner in storage room and shall maintained the record of generation/disposal regularly.
5. The industry shall provide Environmental Data Board at main gate of the industry and danger sign board outside the hazardous waste storage room, within 7 days.
6. The Environmental Engineer, Regional Office-2 Ludhiana shall verify the submissions of the industry and submit further recommendations to decide the consent/ authorization applications.
