It is submitted that earlier the industry was granted authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 on 01.06.2017 (Valid upto 31.05.2022) on the name of M/s Saggu Agriculture Industries. The industry has also obtained consents to operate under the Water Act, 1974 & the Air Act, 1981 vide no. CTOW/Renewal/MOG/2021/15659303 & CTOA/Renewal/MOG/2021/15658961 dated 17.06.2021 for manufacturing of Rice Sheller Machinery Parts @ 1 TPD, valid upto 30.09.2026, subject to the suitable conditions mentioned therein.
Thereafter, the industry has failed to obtain authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016. Accordingly, the industry was issued show cause notice vide Board's letter no. 144 dated 09.01.2024 with an opportunity to apply renewal of authorization. But, the industry has neither applied renewal of authorization nor submitted any reply to the show cause notice.
The industry was visited by officers of the Board on 26.01.2024 and it was observed that the industry was in operation and is generating hazardous waste of category 35.1 of schedule-I of HOWM Rules, 2016 i.e. APCD dust (air cleaning residue), however no record maintained of the same.
The industry is in operation without obtaining authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
Show cause notice for violation of the provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 was issued to the industry alongwith an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 12.03.2024 & 23.05.2024; however no one from the industry attendant the said hearings.
Show cause notice for violation of the provisions of the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 was issued to the industry alongwith an opportunity of personal hearing before the Chief Environmental Engineer (B) of the Board on 15.07.2024 & 22.07.2024. After hearing, it was decided as under:
1. The industry shall ensure to comply with the The Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, at all times and shall also ensure to maintain proper record of the hazardous waste generated / lifted.
2. Environmental Engineer, Regional Office, Faridkot shall visit the industry, verify the compliance at site and process the authorization application applied under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
Now, the industry has applied for obtaining authorization for category 35.1 of schedule-1 (Generation & Storage) under the Hazardous Waste (Management, Handling & Trans-boundary Movement) Rules, 2016, details of which as under:
1. The industry has submitted an copy of agreement with M/s Nimbua Greenfiled (Punjab) Association for lifting of hazardous waste of category 35.1 generated from the industry.
2. The industry has submitted copy of manufacturing process.
3. The industry has submitted copy of partnership deed.
4. The industry has submitted copy of Form-IV and as per Form-IV, the industry has lifted its hazardous waste to TSDF M/s Nimbua Greenfield (Punjab) Limited @ 870 kg on 21.02.2024. Now, it has stored 90 kg in hazardous room.
The industry was visited by the officer of this office on 31.08.2024 and it was observed that:
1. The industry is an induction furnace, which was not in operation during visit.
2. As per Form-4 hazardous waste was stored 90 kg (APCD dust) stored in HDPE bags, which was verified during visit. The industry is maintaining record of generation of HW in a register.
3. The industry has provided danger sign and category of hazardous waste storage facility.
4. The industry has provided environmental data board of size (6'×9'×10') at the main gate as per norms fixed by the Board.
The industry is complying with the provisions of the Hazardous Waste (Management, Handling & Trans-boundary Movement) Rules, 2016.
Recommendations :
In view of the above, it is recommended authorization under the Hazardous Waste (Management, Handling & Trans-boundary Movement) Rules, 2016 may be granted upto the industry for generation & storage of hazardous waste of category 35.1 for five years, subject to the suitable conditions.
