It is intimated that the unit is a hospital and it has applied for obtaining fresh authorization under the Bio-Medical Waste Management Rules, 2016 along with requisite documents for 28 beds capacity under the name of Sh. Maninder Singh.
Further, the Board vide its office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023, has notified authorization fee for HCFs. In this case, the HCF falls in the category of 01-10 beds capacity and accordingly, the HCF has deposited fee of Rs. 6,000/- vide UTR No. 517683584 dated 30.10.2025 under the provisions of BMW Rules, 2016, which is adequate upto 27.02.2026.
The brief details of the case applied by the healthcare facility is as under:-
1. The HCF has made an agreement with M/s Medicare Environment Management Pvt. Ltd., Ludhiana which is valid upto 31/10/2028 for 28 bed capacity.
2. The HCF has submitted site plan.
3. The HCF has submitted copy of manifests of lifting of waste by CBWTF operators.
4. The HCF has submitted self-declaration in form regarding bed capacity of hospital.
5. The HCF has submitted electricity bill as the proof of date of commissioning, date of connection is mentioned as 28.02.2024 and same is considered as date of commissioning.
Moreover, as per the office order no. EPA/2017/No. 5261-86 dated 15/12/2017 the competency of upto 50 beds HCEs and Labs and Blood Banks, Pathological Lab, Veterinary Institutions / Animal House etc. lies with the Environmental Engineer of the Regional Office's.
As per head office order the Authorization cases of HCF upto 20 beds be processed without visit with condition that its inspection can be done at later stage as per protocol.
As per the latest Office Order of the Board vide no. 379 dated 23/10/2023:-
“it has been decided that HCFs upto 30 beds capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal STPs have been installed shall be granted consents to operate and Authorization without installing individual ETPs as an interim arrangement, subject to the condition that HCF shall comply with the effluent standards prescribed by the MOEF&CC under the Bio Medial Waste Management Rules, 2016 as amended from time to time .
In the present case, the HCF is located in City Malerkotla, where the terminal STP has already been installed and the same is in operation.
From above, it is evident that the hospital is complying with the Bio-Medical Waste Rules, 2016.
Keeping in view of above, if approved, the HCF may be granted renewal of authorization upto 31.12.2025 for 28 beds under Bio-Medical Waste Management Rules, 2016 with suitable conditions and with special conditions that:
1. This BMW authorization is valid for 28 Beds only. HCF will apply for fresh authorization if it increases its bed capacity.
2. The HCF will comply with the provisions of BMW Rules, 2016, the Water Act, 1974 and the Air Act, 1981 in true letter & spirit.
3. The HCF shall apply for Consent to operate under Water Act, 1974 and Air Act, 1981 within one month.
4. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same.
5. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste.
6. The HCF will maintain proper record of generation and lifting of bio-medical waste.
7. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
8. The HCF shall comply with the effluent standards prescribed by the MOEF&CC under the Bio Medial Waste Management Rules, 2016 as amended from time to time.
9. The HCF shall obtain other statutory approvals required from other departments, if any.
