File Note: It is submitted that industry is a large scale red category unit engaged in the process of manufacturing of auto parts involving the process of machining, phosphating and powder coating. The industry was earlier granted authorization no. HWM/renew/LDH1/202527369441 dated 14.02.2025 upto 13.08.2025 for category 35.3 @ 4.2 TPA & category 5.1 @ 0.3 KLA. The industry has now applied for obtaining Varied Authorization under Hazardous Waste (Management, Handling & Trans- boundary Movement) Rules, 2016 for category 35.3 @ 4.2 TPA & category 5.1 @ 0.3 KLA and category 37.3@ 0.12 TPA The industry was given an opportunity of personal hearing before the Chairman of the Board on 16.01.2025 w.r.t. show cause notice for refusal of authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016. Senior Environmental Engineer, Zonal Office-1, Ludhiana On behalf of the industry Sh. Kamaljeet Dhiman (Manager HR) The Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a large scale red category unit engaged in the process of manufacturing of auto parts involving the process of machining, phosphating and powder coating. The industry was earlier granted authorization no. HWM/renew/LDH1/2021/ 2890877 dated 05.07.2021 valid upto 31.03.2024 for category 35.3 @ 4.2 TPA & category 5.1 @ 0.3 KLA. The industry has now applied for obtaining renewal of authorization under Hazardous Waste (Management, Handling & Trans- boundary Movement) Rules, 2016 for category 35.3 @ 4.2 TPA & category 5.1 @ 0.3 KLA. The industry has been granted varied consent to operate dated 30.09.2024 both valid upto 30.06.2026 by PBIP with Trade Effluent @ 7KLD - treated in ETP followed by RO (RO permeate reused in process and RO reject lifted by CETP operator) with special condition that the industry shall send its RO reject to M/s JBR Technologies for treatment as per agreement made by it and shall operate its ETP provided for treatment of phosphate effluent followed by RO system regularly and efficiently. A meeting was held under the Chairmanship of Chairman of the Board regarding adoption of zero liquid discharge (ZLD) technology by pickling/electroplating units generating trade effluent more than 150 KL/month and disposing their effluent to CETP for electroplating units on 21.12.2021, wherein it was decided that all the pickling/electroplating industries having made agreement more than 150 KL/month shall submit their proposal to install the ETP based on ZLD technology for treatment of their electroplating/ spent hydrochloric acid (HCl) within three months with timelines to comply within 6 months. The generation of trade effluent is 7 KLD equivalent to 210 KLM (30 days) operation or 175 KLD (25 days) operation. The Board has not given any circular allowing RO plant to be provided by such unit in their premises and RO reject is to be given to CETP operator. Large scale unit are supposed to provide their own ZLD plants and this via-media or circumvent of PPCB instruction is not appropriate. The industry has generation of effluent more than 150 KL/month and it has made agreement with CETP Operator at Ludhiana. It has failed to adopt Zero Liquid Discharge technology, in compliance to the decision of meeting taken by Chairman of the Board on 21.12.2021. In view of above, the industry was issued show cause notice for refusal of authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 with hearing before Chairman of the Board on 16.01.2025. Sh. Kamaljeet Dhiman (Manager HR) of the industry attended the hearing and submitted a written reply which was taken on record. He submitted that the industry is engaged in the process of manufacturing of auto parts. The authorization was granted vide letter no. HWM/renewal/LDH/2021/2890877 dated 05.07.2021 valid upto 31.03.2024. The industry is engaged in the process of machining, phosphating and powder coating only. There is no pickling and electroplating process in the unit. The industry is treating the phosphate effluent in ETP followed by RO system regularly and efficiently. They have made an agreement with M/s JBR Technology of 35 KL/Month to lift the RO Reject water and it is lifted by the CETP Operator regularly. The industry is complying with the provisions of the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 and not made any non-compliance. They start working for the adoption of complete ZLD technology to stop lifting of RO Reject to M/s JBR Technology Pvt. Ltd. Ludhiana and will complete installation of ZLD technology by 30.04.2025. He further requested to allow them to continue with M/s JBR Technologies till the completion of ZLD technology and to grant authorization of the Board. After hearing the industry, officers of the Board and considering material facts on record, the Chairman of the Board decided as under: - 1. The industry shall provide upgraded ZLD so as to stop lifting of RO Reject to M/s JBR Technology Pvt. Ltd. Ludhiana and will complete installation of ZLD technology by 30.04.2025. 2. The industry shall not be allowed to discharge any trade effluent to CETP operator after 30.04.2025. 3. M/s JBR Technology Pvt. Ltd. Ludhiana and LETS shall be directed not to RO reject or any industrial effluent from 01.05.2025 onwards and cancel the existing agreement. 4. The industry shall submit a Bank Guarantee of Rs. 5 lacs, within 15 days, as an assurance regarding installation of ZLD technology by 30.04.2025, failing which Bank Guarantee of Rs. 1 lac will be encashed in each subsequent months. 5. Authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 be granted to industry for short period i.e. six months with above three conditions. 6. Environmental Engineer Regional Office-1, Ludhiana will visit the industry to verify the submissions made by the industry and further recommendation in the matter In compliance of the above , the industry was visited by this office on 14.11.2025 and observed as under:- 1). The industry was in operation during visit. 2). The industry has installed ZLD based ETP including RO system which has been installed before the stipulated time period( Bill invoice attached for kind perusal, thereby complying with the condition of Bank Guarantee) and category 35.3 Hazardous waste is generated from the ETP.. RO permeate is reused and reject fed into the Multi Effect Evaporator for treatment that leads to the generation of category 37.3 Hazardous waste(evaporation residues). The industry has stopped sending RO Reject to CETP operator M/s JBR Technology Pvt. Ltd. Ludhiana. and has already cancelled the agreement with M/s JBR Technology Pvt., Ltd., Ludhiana (copy enclosed) 3). The industry is generating hazardous waste of categories 35.3, 5.1 and 37.3 and has stored 444kg of category 35.3 HW, 90 Litres of category 5.1 HW and 3.5 kg of category 37.3 HW in the HW room. Also the industry has made an agreement with Nimbua TSDF for lifting of category 35.3 @ 4.2 TPA and category 37.3@ 0.12 TPA 4). The industry has provided Hazardous waste storage room of size 20'x9’x8' for category 35.3 & 37.3 stored in HDPE bags and for category 5.1 stored in MS drums/tanks with lock and key arrangement. 5). The industry has provided showing danger sign board and category of hazardous waste at the entrance of room. 6. The industry is maintaining proper record of generation of all the categories of Hazardous Waste being generated in the industry and lifting to reprocessors/Storage Facilities. The records were verified during the visit and found to be in order. 7. The industry has last got lifted 1150 Kg of category 35.3 on 24.05.2025 to M/s (TSDF) Nimbua Green field. 8. The industry has made an agreement with authorized recycler i.e. M/s Satkar Oil for lifting its hazardous waste category 5.1. and last got lifted 289Litres dated 23.01.2025 9). The industry has submitted Form 4 and the HW generated, stored and disposed off all are in consonance.. 10. The industry has cancelled the agreement of getting the RO reject lifted by M/s JBR Technology Pvt. Ltd . 11) The industry has obtained consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 which is valid upto 31.03.2028. 12) The industry is complying with the decisions of the personal hearing and the provisions of Hazardous Waste (Management, Handling & Transboundary Movement) Rules, 2016. In view of the above, it is recommended that authorization for collection, storage & disposal of hazardous waste under category 35.3 @ 4.2 TPA & category 5.1 @ 0.3 KLA and category 37.3@ 0.12 TPA may be granted to the industry for five years upto 31.03.2030 with suitable conditions please.( Competency= Worthy Chairperson of the Board)
