It is submitted that the Sub-Health Centre (SHC) has applied for obtaining fresh authorization under the Bio-Medical Waste Management Rules, 2016 through OCMMS, for the operation of a non-bedded dispensary. The SHC has submitted a letter vide no. 2701 dated 12.09.2025 issued by Senior medical officer CHC Lambi, Sri Muktsar Sahib in which it is stated that the Dispensary Ghumaira of the Zila Parishad falls under the Lambi Block and comes under the Department of Rural Development and Panchayats, Punjab. According to the In-charge of the Dispensary (Pharmacist Surinderpal), the daily biomedical waste generated is less than 500 grams. Therefore, the In-charge of the Zila Parishad's Dispensary Ghumaira is directed to ensure that whatever daily biomedical waste is generated under their dispensary is deposited from time to time at the CHC Lambi and that its record is properly maintained. The biomedical waste from CHC Lambi is deposited with Medwaste Solutions Pvt. Ltd., a firm located in Village Bidowali……......
It is pertinent to mention that as per Board’s office order no. EPA/2020/04 dated 09.06.2020: “All dental clinics having one dental chair, as well as other clinics with one examination table, shall be considered as non-bedded Health Care Facilities under the applicability of the BMW Rules, 2016. However, such HCFs shall submit an undertaking to the effect that they do not have any facility to admit or keep patients for a day under observation at the time of obtaining authorization.” Further, as per Board’s office order no. EPA/2018/01 dated 03.01.2018, a one-time authorization under the BMW Rules, 2016 shall be granted to non-bedded HCFs, subject to the condition that fresh authorization shall be sought if the HCF becomes bedded. Also, as per Board’s office order no. EPA/2018/04 dated 10.04.2018, the authorization (Fresh/Renewal) under the Bio-Medical Waste Management Rules, 2016, applied by Health Care Facilities up to 20 beds/dental chairs, shall be granted by the concerned Regional Office within 07 days of receipt of a complete application, without inspection. Moreover, as per Board’s office order no. EPA/2017/5261-86 dated 15.12.2017, the competency for granting authorization to HCFs up to 50 beds, including Labs, Blood Banks, Pathological Labs, Veterinary Institutions, and Animal Houses, lies with the Environmental Engineer of the Regional Office……….
In view of the above, if approved, one-time authorization may be granted to the HCF for operating the dispensary, subject to the general provisions of the BMW Rules, 2016 and the following specific conditions:
1. This authorization shall not be construed as permission to operate the Health Care Facility in a non-designated area. The HCF shall be responsible for obtaining all requisite permissions/clearances from other departments, as applicable.
2. The occupier shall take all precautionary measures to prevent leakage/spillage of Bio-Medical Waste from the storage area. The storage area shall be properly fenced/protected and marked with cautionary signboards.
3. The Bio-Medical Waste shall be handled only by qualified/trained personnel.
4. The authorization is subject to the general conditions imposed and such conditions as may be prescribed under the Environment (Protection) Act, 1986 and the Rules made thereunder.
5. The HCF shall comply with the Bio-Medical Waste Management Rules, 2016.
6. The authorized person shall not rent, lend, sell, or otherwise transfer the Bio-Medical Waste without prior approval of the prescribed authority.
7. Any unauthorized change in personnel, equipment, or working conditions mentioned in the application shall constitute a breach of authorization.
8. The authorized person shall obtain prior permission from the prescribed authority before closure of the facility, and shall comply with any other conditions stipulated by the authority.
9. This authorization is based on the declaration that the HCF has no facility for admitting patients for observation. Fresh authorization shall be sought in case the HCF becomes bedded.
10. The HCF shall apply for Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, within one week.
11. The chemical liquid waste generated shall be treated with 1–2% sodium hypochlorite solution prior to disposal.
