Aggarwal & Company, Industrial Area-C, Near PSPCL Substation, Kanganwal, Ludhiana. The Following were present: On behalf of Punjab Pollution Control Board Er. Ravinder Bhatti, Senior Environmental Engineer, Zonal Office-1, Ludhiana Er. Amit Kumar, Environmental Engineer, Zonal Office-1, Ludhiana On behalf of the industry Sh. Shub Nath Aggarwal, Partner The Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry is a medium scale red category unit and has obtained 'Consent to Operate' under Water Act, 1974 and Air Act, 1981 both valid upto 31/03/2026 for manufacturing of Bicycle Brake @ 40000 Numbers/Day. The industry has now applied for fresh authorization under the Hazardous and Other Wastes Rules, 2016 for generation, storage, transportation & disposal of hazardous waste Category 5.1 (-Used or spent oil) @ 0.20 KL/Annum, Category 5.2 (Wastes or residues containing oil) @ 0.1 KL/Annum, Category 5.3 (Waste cutting oils) @2.00 KL/Annum, Category 33.1 (empty barrel) @ 1000 No.s/annum, Category 33.2 (Contaminated cotton rags or other cleaning materials) @ 2.400 T/annum, Category 35.3 (Chemical sludge from waste water treatment) @ 9.600 TPA. The authorization application of the industry was perused and it has been observed as under:- 1. The industry earlier have obtained CTO for getting its trade effluent lifted to CETP operator. The source of chemical sludge generation is not clear, for which authorization for hazardous waste category 35.3 @ 9.6 TPA is applied. 2. Lot of Hazardous waste is still lying in the premises. The hazardous waste of category 5.1 @ 40 ltr, Category 5.3 @ 790 ltr Category 33.1 @ 251 no., Category 33.2 @ 310 kg, Category 35.3 @ 4400.3 Kgs is lying stored with the industry. In view of above, show cause notice for refusal of authorization under the Hazardous and other Waste Rules, 2016 was issued to the industry with hearing before the CEE, Ludhiana on 10.11.2025. Sh. Shub Nath Aggarwal, Partner of the industry attended the hearing and submitted written reply which has been taken on record. He further submitted that the waste water produced from the electroplating (zinc plating) process is lifted by JBR Technologies Limited (CETP). The industry has installed a number of vibrators as pre-surface treatment before electroplating of the product. The industry treat the waste water generated from the vibrators in the settling tanks which generate the sludge under category 35.3. The clarified water is re-used in the process. The industry generates hazardous waste of categories 5.1, 5.2, 5.3, 33.1, 33.2 from its process. Earlier, the industry had made agreement with M/s Aggarwal Mfg Company (authorized re-cycler) for lifting of hazardous waste of categories 5.1, 5.2, 5.3, 33.1 and TSDF Nimbua for lifting of hazardous waste under categories 35.3 & 33.2. Now, M/s Aggarwal Mfg Company has not been authorized by the Board for re-cycling the waste under category 5.2 & 5.3. As such, the industry is in a process for making agreements with companies which are authorized by PPCB for disposal off hazardous waste of categories mentioned above. He assured that the hazardous waste stored by the industry under categories 5.1, 33.1, 33.2 & 35.3 shall be disposed off with the TSDF Nimbua/ M/s Aggarwal Mfg Company within 15 days and the industry shall submit the new agreements being made for disposal of categories 5.2 & 5.3 within one month. He further requested to grant authorization for disposal of the sludge of above categories. After hearing, the industry officer of the Board and considering background of the case and material facts on the record, the Chief Environmental Engineer of the Board decided that: 1. The industry shall dispose off the hazardous waste stored under categories 5.1, 33.1, 33.2 & 35.3, within 15 days and shall submit the manifest to the Regional Office-2, Ludhiana immediately thereafter. 2. The industry shall submit the copies of agreement made with authorized agencies, for disposal of the categories 5.2 & 5.3 of hazardous waste being generated by it to Regional Office-2, Ludhiana, within one month. Till then, the industry shall store & dispose off its hazardous waste as per the provisions of Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016. 3. The authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 be granted to the industry upto 31.03.2026 (i.e. upto validity of consent granted under the Water Act, 1974) with condition that the industry shall comply with the above said decision no. 1 & 2 in true letter & spirit. 4. The Environmental Engineer, Regional Office-2, Ludhiana shall visit the industry after one month to verify the submission made by the industry during hearing and submit report alongwith recommendations in the matter. Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
