File Note: It is submitted that the industry was earlier served show cause notice for violation of the provisions of the Hazardous & Other Waste (Management & Transboundary Movement) Rules, 2016, framed under EPA, 1986 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1). After hearing, the Senior Environmental Engineer (ZP-I) of the Board decided as under: 1) The industry shall not start its process which are covered under Orange/Red Category as per categorization of the Board. 2) The industry shall manage the hazardous waste generated from its premises as per Hazardous & other Waste (Management & Transboundary Movement) Rules, 2016. 3) The industry shall obtain authorization under the Hazardous & other Waste (Management & Transboundary Movement) Rules, 2016 for its existing processes being carried out in its premises. 4) The Environmental Engineer, Regional Office, Mohali shall verify the statement of the industry and process/decide the application of the industry to be applied under the Hazardous & other Waste (Management & Transboundary Movement) Rules, 2016 on merits. Thereafter, the service station was visited by the officer of the Board on 06.07.2023 and during visit it was observed that the service station was in operation. The service station is involved in sale of cars, repair of cars of brand ISUZU and MG Hector. The service station is also involved in servicing of JCBs. The service station has disconnected compressor installed in it for washing of cars. The service station has removed the paint booth earlier installed in its premises. The project proponent has not obtained authorization under HWM Rules, 2016. The industry was issued show cause notice for violation of the provisions of the Hazardous Waste Management Rules, 2016 with opportunity to submit reply within 15 days. Therefore, the project proponent had applied authorization and the same was returned due to some observations. The industry was visited by the officer of the Board on 29.09.2025 and during visit it was observed as under: 1. The service station is being operated in JLPL Industrial Area which has been approved for establishment of only green category units. 2. The service station was in operation. The service station is involved in sale of cars, repair of cars of brand ISUZU, MG Hector and BYD. The service station is also involved in servicing of JCBs. 3. The service station is not involved in washing and painting of the cars. 4. The service station has a staff of around 80-90 employees. 5. The service station has installed DG set of capacity 200 KVA with canopy and adequate stack height. 6. The service station has provided one room for storage of used oil & used filters generated from servicing of SML Isuzu and MG Hector cars. 7. The industry has stored 10 Oil drums and 21 oil filters in the room. The industry has maintained record of generation of used oil but could not produce record of used filter. The industry has last lifted 16 no. barrels of used oil to Jai Ambay refinery, Sangrur vide manifest no. 4451 dated 11.06.2025 and no manifest slips was shown by the project proponent for lifting of used filter. 8. The service station has not obtained authorization under HWM Rules, 2016 till date. 9. The service station has obtained auto-renewal consent to operate under Water Act, 1974 and Air Act, 1981 both valid till 12.09.2029. The industry was issued show cause notice for violation under the Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 alongwith another opportunity of personal hearing before the Senior Environmental Engineer (P), on 24/10/2025. The representatives of the industry attended the hearing and submitted written reply which has been taken on record. He further assured that all the violations/ shortcomings pointed out by the visiting officer of the Board, has been rectified at site and they are under process for applying for authorization under the Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016. After hearing the representatives of the industry, officers of the Board, and material facts on the record, the SEE of the Board decided that:- 1. The industry shall submit a bank guarantee amounting to Rs. 2.0 lakh as an assurance to comply with the Environmental Norms and the directives/ orders of the Board, at all times. 2. The industry shall manage the hazardous waste generated from its premises as per Hazardous & other Waste (Management & Transboundary Movement) Rules, 2016. 3. The industry shall obtain authorization under the Hazardous & other Waste (Management & Transboundary Movement) Rules, 2016 for its existing processes being carried out in its premises. 4. Environmental Engineer, Regional Office, SAS Nagar shall verify the statement of the industry and process/decide the application of the industry to be applied under the Hazardous & other Waste (Management & Transboundary Movement) Rules, 2016 on merits. Now, the industry has applied for obtaining authorization under Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for Collection, Storage, Disposal of hazardous wastes 5.1-Used or spent oil @ 10 KL/Annum and 5.2- Wastes or residues containing oil @ 2169 No./Annum along with requisite documents. The project proponent has submitted copy of agreement for lifting of hazardous waste of 5.1 with M/s Jai Ambey Refinery, Village-Ubhawal, Sangrur. The project proponent has submitted copy of agreement for lifting of hazardous waste of category 5.2 with TSDF Nimbua. Accordingly, the industry was visited by undersigned on 12.11.2025 and it was observed as under: 1. The service station was in operation. The service station is involved in sale of cars, repair of cars of brand ISUZU, MG Hector and BYD. The service station is also involved in servicing of JCBs. 2. The industry has provided proper hazardous waste room of size 10’ x 15’ x 6’ for the storage of hazardous wastes of all the above-mentioned categories. The project proponent has not provided danger sign Board outside the hazardous waste room. 3. The industry is storing the hazardous waste in the storage facility in an environmentally sound and proper manner. 4. The project proponent has stored category 5.1 @ 25 x 210 ltr and 5.2 @ 200-250 No. in the hazardous waste room. The industry has lifted hazardous waste of category 5.1 @ 16 no. drums vide manifest no. 4451 dated 11.06.2025 and has not yet lifted hazardous waste of category 5.2. 5. The project proponent has submitted Form- 4 as per which total generation of category 5.2 @ 1286 no till 31.03.2025. During visit approx 200-250 no. filters were stored in the hazardous waste room. However, the industry has failed to produced manifest slips for lifting of hazardous waste category 5.2. 6. The project proponent has failed to deposit bank guarantee amounting to Rs. 2 lakh in compliance of hearing decisions. In view of above, it is recommended that the authorization under Hazardous Waste Management Rules, 2016 may be refused with an opportunity of personal hearing. *Competency – Senior Environmental Engineer
