• It is submitted that the industry is a large-scale orange category spinning unit. The industry was earlier granted authorization for generation, collection, storage and disposal of hazardous waste of category 5.1. @ 0.4 KL/Annum, under HOWM Rules, 2016 vide no. HWM/Fresh/MKS/2021/14366788, which was valid up to 30.09.2025 with certain conditions mentioned therein…………….
• Now, the industry has applied for renewal of authorization under HOWM Rules, 2016 through OCMMS on 05.10.2025……………
• The industry has submitted an agreement made with M/s Satkar Oil Co., Ludhiana (authorized recycler) for lifting of waste oil (hazardous waste of category 5.1)………….
• The industry has also submitted copy of record maintained for Hazardous Waste generation & its disposal w.e.f. 29.01.2021 to 24.09.2025, indicating a closing balance of hazardous waste of category 5.1 NIL as on 24.09.2025…………….
• The industry has lastly lifted 325 liter of category 5.1 to the authorized recycler on 24.09.2025 and also submitted manifest regarding lifting of hazardous waste………
• The industry has maintained HW generation & disposal record in FORM 3 and annual return of Hazardous Wastes generation & disposal has been submitted in FORM 4…………
• The industry was visited by Regional Office on 10.10.2025 and it was observed as under: -
1. The industry has provided a hazardous waste storage facility of size 13’-8’’x8’ with impervious flooring and roof of ACC sheets to avoid entry of rain water or any other source…….
2. There is no hazardous waste stored inside the hazardous waste storage room by the industry. The industry representative informed that the industry has disposed of 2 drums of total capacity of 325 liters used/spent oil from D.G. sets to authorized recycler ………..
3. The industry has provided a danger sign with the hazardous waste storage facility……………
4. The industry has maintained record of hazardous waste generated & disposed off along with a copy of the agreement with M/s Satkar Oil Co., Ludhiana.
5. The industry has installed an Environmental Data Display Board outside the main gate, showing key environmental parameters as per regulatory requirements. However, during inspection, a few discrepancies were observed in the displayed values, which did not fully align with the monitored data. The industry has been advised at site to correct the same.
• RO has reported that the industry is complying with the conditions of authorization granted to it under the Hazardous waste (management, handling and transboundary movement), Rules, 2016 and recommended for grant of authorization upto 30.09.2028………..
• It is further added that the record maintained by the industry w.e.f. 01.01.2021 to till date has been examined and it is observed that the industry is generating 65 liters of used oil (category 5.1) every year against the authorized quantity of 400 liters.……….
Keeping in view of above and recommendations of RO, if approved, the validity of authorization under the HOWM Rules, 2016 may be extended upto 30.09.2026 with following special conditions: -
1. The industry shall apply for varied authorization under the HOWM Rules, 2016 based on the actual quantity of hazardous waste generation……….
2. The industry shall make registration on National Hazardous Waste Tracking System (NHWTS), within 7 days…………
3. The industry shall update & provide the actual environmental data on the environmental data board provided outside the main gate of the industry………….
4. The hazardous and other wastes generated in the establishment of an occupier shall be sent or sold to an authorized actual user or shall be disposed of in an authorised disposal facility…………
5. The hazardous and other wastes shall be transported from an occupier’s establishment to an authorised actual user or to an authorised disposal facility in accordance with the provisions of these rules………….
6. The industry shall provide dedicated room for storage of hazardous waste with lock & key arrangement and shall provide danger sign board outside the room………..….
7. The industry shall maintain record of hazardous and other wastes handled by it in Form 3………..
8. The industry shall file an annual return in Form 4 to the Board on or before the 30th day of June following the financial year to which that return relates………….
9. The industry is responsible for safe and environmentally sound management of hazardous and other wastes………….
