File Note: Kindly peruse the agenda note of the Regional Office and the comments of EE, ZO. The industry is a large-scale red category phosphating and powder-coating unit earlier granted authorization on 14.02.2025 up to 13.08.2025 for Category 35.3 @ 4.2 TPA and Category 5.1 @ 0.3 KLA. The case was earlier placed in personal hearing before the Chairperson on 16.01.2025 regarding refusal of authorization, wherein directions were issued to install an upgraded ZLD system by 30.04.2025, stop lifting/discharge of RO reject to M/s JBR Technology Pvt. Ltd., cancel the existing agreement, submit a Bank Guarantee of Rs. 5 lakh, and authorization was to be granted only for a short period with these conditions. In compliance, the industry was visited on 14.11.2025 and was found in operation. The unit has installed a ZLD-based ETP with RO and MEE before the stipulated date; RO permeate is reused, and RO reject is treated through MEE, generating Category 37.3 residue. The industry has stopped sending RO reject to CETP and has cancelled its agreement with M/s JBR Technology Pvt. Ltd. The unit is generating hazardous waste under Categories 35.3, 5.1 and 37.3 and has stored 444 kg of Category 35.3, 90 litres of Category 5.1 and 3.5 kg of Category 37.3 waste in a dedicated hazardous waste storage room with proper lock-and-key arrangements, signage and record maintenance. Agreements with Nimbua TSDF (for Categories 35.3 and 37.3) and M/s Satkar Oil (for Category 5.1) are in place, and disposal records and Form-4 submissions were verified as correct and in order. As the industry has installed ZLD, cancelled the CETP agreement and complied with the directions of the personal hearing as well as the provisions of the Hazardous and Other Waste (Management & Transboundary Movement) Rules, 2016, it is recommended that authorization for collection, storage and disposal of hazardous waste under Category 35.3 @ 4.2 TPA, Category 5.1 @ 0.3 KLA and Category 37.3 @ 0.12 TPA may be granted for five years up to 31.03.2030 with suitable conditions.
