File Note: The HCF was granted authorization under Bio-Medical Waste Management Rules, 2016 vide no. BMW/Renewal/SAS/2025/28463498 dated 19.04.2025 for 20 beds, valid till 19.04.2026 for generation & collection of bio medical waste in the name of Giostar Healthcare Pvt Ltd with certain conditions. Now, the hospital has applied for fresh authorization under Bio-Medical Waste Management Rules, 2016 for operating a hospital having 20 beds in the name of Jeevasa Research Pvt. Ltd. The industry has deposited BMW authorization fee amounting to Rs 2000/- vide R no. 801760903 dated 26.11.2025, which is adequate till 27.11.2026. As per H.O.Patiala Office Order No. EPA/2018/No. 04 dated 10.04.2018 the authorization (fresh/renewal) under the Bio-Medical Waste Management Rules, 2016 applied by the healthcare facilities upto 20 beds/dental chairs will be granted by the concerned Regional Office within 7 days of receipt of complete application without making inspection of those healthcare facilities. However, the concerned Regional Office shall ensure that no action is pending against the concerned health care facility for violation of the Bio-Medical Waste Management Rules, 2016, Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and various rules made there-under. In light of above office orders, the inspection is not required as the healthcare facility having 20 beds only. The brief detail of the case applied by the healthcare facility is as under:- 1. The HCF has submitted the Location Plan of the HCF. 2. The HCF has made an agreement with M/s Rainbow Environments Pvt. Ltd., Village Balyali, Tehsil Kharar on 16.09.2025 which is valid upto 15.09.2028 for 20 bed capacity in the name of Jeevasa. 3. As per record of this office, no action is pending against the health care facility for violation of the (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986. 4. The HCF has enclosed manifests of lifting BMW to M/s Rainbow Environments Pvt. Ltd., Mohali. 5. The HCF has located in MC limit. It is further submitted that as per Board’s office order no. 379 dated 27.10.2023 for grant of consents to operate under the Water Act, 1974, the Air Act, 1981 and authorization under the Bio-Medical Waste Management Rules, 2016 as amended from time to time to Health Care Facilities (HCFs) in which it has been mentioned that: “Precisely stated, the Ministry of Environment, Forest and Climate Change (MoEF&CC), Govt. of india, vide notification dated 19.02.2019 has made the amendment in the Schedule-l appended to the Bio-Medical Waste Management Rules, 2016 to the effect that Health Care Facilities having less than ten beds shall have to comply with the output discharge standard for liquid waste by 31st December, 2019. However, the Indian Medical Association (IMA), Punjab had submitted various representations from time to time and on 09.10.2023 wherein PPCB has been requested to grant consents to operate under the Water Act, 1974, the Air Act, 1981 and authorization under the Bio-Medical Waste Management Rules, 2016 to Health Care Facilities (HCFs) without installation of STP -cum-ETP by medium level hospitals due to the various reasons as mentioned in their representations. 3) After considering the representation submitted by the IMA Punjab and examination of the matter, the Competent Authority of the Board has decided to constitute a committee of technical officers of the Board comprising of various hierarchical positions vide office order no. 378 dated 27.10.2023 to examine the matter in detail, practice adopted by the other State Boards, letters/clarifications/guidelines issued by the MoEF&CC/CPCB etc., if any and to submit the report for taking further action in the matter. 4) In view of the above stated facts it has been decided that HCFs up to 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents to operate. under the Water Act, 1974 and the Air Act, 1981 as well as authorization by Punjab Pollution Control Board (PPCB) without installation of individual ETPs, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-Medical Waste Management Rules, 2016 as amended upto to date and subsequent amendments if any. 5) This order will supersede the earlier office orders passed by the Board with regard to the issue aforementioned and shall come into with immediate effect.” In view of above, if may approved, it is recommended that authorization under the Bio-Medical Waste Management Rules, 2016 may be granted to the HCF till 26.11.2026 subject to the suitable conditions and following additional conditions as under:- 1. This authorization is valid only for 20 no. beds. 2. The HCF shall apply for fresh authorization under Bio-Medical Waste Management Rules, 2016 in case its increase its beds capacity. 3. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year. 4. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis. 5. The HCF shall obtain other statutory approvals required from other departments, if any. 6. The HCF shall comply with the Board’s office order no. 601 dated 16.12.2021 and its subsequent amendments, if any. Competency: EE (RO) as per policy of the Board.
