File Note: Online application ID 30406972 dated 16.11.2025. It is submitted that the Health Care Facility (HCF) was granted Authorization under the Bio Medical Waste Management Rules, 2016, vide no. BMW/Fresh/LDHKH/2024/25917298 dated 19.06.2024 valid upto 31.03.2028 for 48 beds. Further, the HCF has also obtained consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/LDHKH/2024/25828990 dated 19.06.2024 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/LDHKH/2024/25829057 dated 19.06.2024, both are valid upto 31.03.2028 for operation of 48 no. beds subject to the suitable terms & conditions mentioned therein. Thereafter, a complaint was received in this office as published in newspaper on 17.08.2025 regarding illegal dumping of bio-medical waste mixed with municipal solid waste near Samrala Chowk, Khanna. Accordingly, the area under complaint and nearby area was visited by various teams of the Regional Office, Fatehgarh Sahib and during inspection the subject cited HCF was also visited. During visit, the HCF was found violating the provisions of the Bio-Medical Rules, 2016 by not handling its bio-medical waste properly and also violating the provisions of the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. Accordingly, Show cause notice for revocation/ cancellation of consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 as well as cancellation of authorization granted under BMW Rules, 2016 was issued to the HCF alongwith an opportunity of personal hearing before the Senior Environmental Engineer, ZP-II on 29.09.2025, wherein, it was decided as under: 1. The HCF shall apply for fresh authorization under Bio-Medical Waste (Management) Rules, 2016 for 100 beds within 7 days. 2. The HCF shall apply for varied consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation and occupancy of 100 beds within 7 days. 3. The HCF shall operate its ETP cum STP regularly to achieve the prescribed standards laid by the Board. 4. The HCF shall submit bank guarantee amounting to Rs. 2.0 lakh as an assurance to comply with Bio-Medical Waste (Management) Rules, 2016 as well as under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. 5. Environmental Engineer, Regional Office, Fatehgarh Sahib shall carry out the monitoring of the ETP cum STP after 15 days and shall verify the compliance of Bio-Medical Waste (Management) Rules, 2016 as well as the provisions of Water Act, 1974 & Air Act,1981. He shall also check as to whether the HCF has installed separate ETP & STP & thereafter submit the report, accordingly. 6. It was made clear to the HCF that in future if any solid waste is found mixed with bio-medical waste by the officer of the Board during visit then action as deemed fit shall be taken under Bio medical Waste Management Rules, 2016 without giving any further opportunity of hearing. In compliance to the hearing decision no. 4, the HCF has submitted the bank guarantee amounting to Rs. 2.0 lacs vide no. 034GT02253020003 dated 29.10.2025, which is valid upto 08.11.2026. Now, in compliance to the hearing decision no. 1, the HCF has applied for obtaining fresh authorization under Bio-Medical Waste (Management) Rules, 2016 for operation of 100 beds alongwith requisite documents and fee. The HCF has submitted an agreement for 100 no. of beds executed with the Common Bio Medical Waste Treatment Facility namely M/s Medicare Environmental Management Pvt. Ltd. Behind Satluj Action Water Treatment Plant, Opp. Central Jail, Tajpur Road, Ludhiana for lifting and treatment of Bio Medical waste generated from the HCF on 01/10/2025, which is valid upto 30.09.2030. As per the record, the earlier fee deposited by the HCF was adequate upto 31.03.2028 under the Bio-Medical Waste (Management) Rules, 2016 against 48 no. beds. Now, the HCF has deposited Rs. 18,000/- vide online R. No. 553512122 dated 27.11.2025 under the Bio-Medical Waste (Management) Rules, 2016. As such, the fee deposited by the HCF is adequate upto 31.10.2030 under the Bio-Medical Waste (Management) Rules, 2016 against 100 no. beds as per Govt. notification dated 19.01.2023. Further, the HCF has submitted the completion certificate of ETP-cum-STP of capacity 50 KLD (10 KLD + 40 KLD) for treatment of its effluent generated from OT & laboratory and domestic wastewater issued by RK Environment Engineers dated 24.10.2025. Visit: To verify the compliance of hearing decisions, the hospital was visited by the undersigned on 13.11.2025 and Sh. Amit Juneja, General Manager was contacted. During visit, it was observed as under: 1. The hospital was in operation. 2. During visit, it was observed that the HCF has installed 100 no. beds. 3. The bio-medical waste generating points of HCF were visited and found that segregation of bio medical waste proper as per Bio Medical Waste Management Rules, 2016. 4. The Hospital has provided color coded bins for segregation of biomedical waste. 5. The Hospital has provided shredders/ cutters for shredding of used needles and same were found in working condition. 6. The Bio-medical waste of blue category i.e. used gloves and bottles were found cut before disposal. 7. The hospital has provided a storage room for bio-medical waste and has maintained the record of Bio-Medical Waste Category wise, being lifted by the CBMWTF. 8. The hospital has installed 01 no. submersible pump for the abstraction of ground water. The HCF has installed water meter on the same and is maintaining the record of the same. 9. The HCF has installed ETP-cum-STP of capacity 50 KLD for treatment of its effluent generated from OT & laboratory and domestic wastewater. During visit, the ETP-cum-STP was found in operation and the samples were collected & sent to the Water lab for analysis for which the results are awaited. 10. The final outlet from the ETP-cum-STP is being discharged partially into MC sewer, which is further connected with the terminal STP of Khanna and partially into plantation area developed in within the premises. 11. The HCF has provided flow meter at the inlet and outlet of the ETP-cum-STP. 12. The HCF has installed 01 no. DG set of capacity 200 KVA, which is equipped with canopy and stack of adequate height. Recommendations: In view of the above, it is recommended that the hospital may be granted fresh authorization under Bio-Medical Waste Management Rules, 2016 for operation of 100 no. beds upto 30.09.2030 with suitable conditions and additional conditions that: 1. The HCF shall apply for fresh authorization under Bio-Medical Waste Management Rules, 2016, if it increases its bed capacity. 2. The HCF shall ensure to comply with the effluent standards as notified under Bio Medical Waste Management Rules, 2016 amended upto date and subsequent amendments, if any. 3. There is no claim of continuation of HCF in present premises on the basis of this consent. The HCF has to comply with the zoning regulation of master plan & to be shifted from the site as and when asked by the Govt./PPCB/ or any concerned Govt. agency. 4. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same. 5. The HCF shall obtain other statutory approvals required from other departments, if any.
