It is submitted that the HCF was granted authorization under Bio-Medical Waste Management Rules, 2016 vide no. BMW/Fresh/SAS/2024/26882932 dated 23.09.2024 valid upto 30.06.2025 for operation of 4 beds, subject to certain terms and conditions.
Now, the HCF has applied for obtaining authorization under the Bio-Medical Waste Management Rules, 2016 for 15 beds alongwith requisite documents.
As per H.O. Patiala Office Order No. EPA/2018/No. 04 dated 10.04.2018 the authorization (fresh/renewal) under the Bio-Medical Waste Management Rules, 2016 applied by the healthcare facilities upto 20 beds/dental chairs will be granted by the concerned Regional Office within 7 days of receipt of complete application without making inspection of those healthcare facilities. However, the concerned Regional Office shall ensure that no action is pending against the concerned health care facility for violation of the Bio-Medical Waste Management Rules, 2016, Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and various rules made there-under.
In light of above office orders, the inspection is not required as the HCF having 15 no. beds. The brief detail of the case applied by the healthcare facility are as under:-
1. The HCF has submitted the Location Plan of the HCF.
2. The HCF has made an agreement with M/s Rainbow Environments Pvt. Ltd., Village Balyali, Tehsil Kharar valid upto 09.04.2028 for 15 no. beds.
3. As per record of this office, no action is pending against the health care facility for violation of the (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986.
It is submitted that Board has issued partial modification to earlier Board’s order no. 468 dated 31.08.2021, vide its office order no. 601 dated 16.12.2021 has decided that the HCF upto 50 beds which are discharging there liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plant have been installed, shall be granted consents/ authorization by Punjab Pollution Control Board without installation of individual ETPs, as an interim arrangements/ measures, subject to condition that the HCF shall ensure to comply with the effluent standards as notified and Bio-medical Waste Management Rules, 2016, amended upto date and subsequent amendments if any. However, no specific period mentioned in the said orders.
It is further submitted that as per Board’s office order no. 379 dated 27.10.2023 for grant of consents to operate under the Water Act, 1974, the Air Act, 1981 and authorization under the Bio-Medical Waste Management Rules, 2016 as amended from time to time to Health Care Facilities (HCFs) in which it has been mentioned that:
“Precisely stated, the Ministry of Environment, Forest and Climate Change (MoEF&CC), Govt. of india, vide notification dated 19.02.2019 has made the amendment in the Schedule-l appended to the Bio-Medical Waste Management Rules, 2016 to the effect that Health Care Facilities having less than ten beds shall have to comply with the output discharge standard for liquid waste by 31st December, 2019. However, the Indian Medical Association (IMA), Punjab had submitted various representations from time to time and on 09.10.2023 wherein PPCB has been requested to grant consents to operate under the Water Act, 1974, the Air Act, 1981 and authorization under the Bio-Medical Waste Management Rules, 2016 to Health Care Facilities (HCFs) without installation of STP -cum-ETP by medium level hospitals due to the various reasons as mentioned in their representations.
3) After considering the representation submitted by the IMA Punjab and examination of the matter, the Competent Authority of the Board has decided to constitute a committee of technical officers of the Board comprising of various hierarchical positions vide office order no. 378 dated 27.10.2023 to examine the matter in detail, practice adopted by the other State Boards, letters/clarifications/guidelines issued by the MoEF&CC/CPCB etc., if any and to submit the report for taking further action in the matter.
4) In view of the above stated facts it has been decided that HCFs up to 30 bed capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plants (STPs) have been installed, shall be granted consents to operate. under the Water Act, 1974 and the Air Act, 1981 as well as authorization by Punjab Pollution Control Board (PPCB) without installation of individual ETPs, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the Ministry of Environment, Forest and Climate Change under Bio-Medical Waste Management Rules, 2016 as amended upto to date and subsequent amendments if any.
5) This order will supersede the earlier office orders passed by the Board with regard to the issue aforementioned and shall come into with immediate effect.”
The HCF has submitted sewerage bill issued by Municipal Council, Kharar regarding connectivity of sewer with terminal STP installed by Municipal Council, Kharar.
The HCF has deposited Rs. 4000/- (two years fee) vide R. No. 68077642 dated 27.11.2025 under Bio-Medical Waste Management Rules, 2016 fee as per Board’s office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023.
In view of above, it is recommended that authorization under the Bio-Medical Waste Management Rules, 2016 may be granted to the HCF upto 30.06.2027, subject to the suitable conditions and following additional conditions as under:-
1. This authorization is valid only for 15 no. beds.
2. The HCF shall apply for fresh authorization under Bio-Medical Waste Management Rules, 2016 in case its increase its beds capacity.
3. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same and intimate to the Board.
4. The authorization is valid for category and quantity of bio medical waste as mentioned in the certificate. If in case the HCF starts generating bio medical waste more than authorized quantity for any category it shall obtain fresh authorization from the Board.
5. The HCF will use 1-2% sodium hypo-chlorite solution for disinfection of chemical liquid waste generated in the HCF and keep the record of the consumption of the Sodium hypochlorite solution.
6. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
7. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis.
8. The HCF shall obtain other statutory approvals required from other departments, if any.
9. The HCF shall comply with the Board’s office order no. 601 dated 16.12.2021 and its subsequent amendments, if any.
