Subject : Application for fresh authorization under Bio-Medical Waste Management Rules, 2016 - M/s Janak Surgicare & Ankur Advanced Urology Centre, 47, Ranjit Bagh, Patiala.
Ref: The HCF application no. 30475979 dated 26.11.2025.
It is submitted that the HCF has obtained authorization under Bio Medical Waste Management Rules, 2016 vide no. BMW/Renewal/PTA/2024/26387382 dated 26/07/2024 valid upto 26/07/2029 under the name M/s Janak Surgicare for 10 beds capacity with certain conditions.
Now, the HCF has applied for obtaining fresh authorization under the Bio-Medical Waste Management Rules, 2016 under the new name & style M/s Janak Surgicare & Ankur Advanced Urology Centre along with requisite documents for having 10 beds capacity.
The HCF had entered into an agreement with by M/s Rainbow Environments at Mohali for collection, transportation, treatment and disposal of bio-medical waste generated by it which is valid upto 20.11.2025 to 19.11.2030 for 10 beds capacity.
Accordingly, as per the latest order of Govt. notification no. STE-STEB010/213/2020- STE(5/4)/485954 dated 06.01.2023 has notified the fee for obtaining authorization under the provisions of the BMW Rules, 2016, which is to be paid by the applicant at the time of submitting the application for obtaining authorization: Sr. no. Category Authorization fee under BMW Rules, 2016, 1. Non-bedded HCFs Rs. 1000/-(One Time) 2. With Bed Capacity 1-10 beds Rs. 1000/- per annum 3. With Bed Capacity 11-30 beds Rs. 2000/- per annum 4. With Bed Capacity 31-50 beds Rs. 3000/- per annum, respectively.
The HCF has deposited fee deposited to Rs. 5000/- vide UTR no. 692679493 dated 28/11/2025. The fee deposited is adequate upto 19/11/2030. As per H.O. Patiala Office Order No. EPA/2018/No. 04 dated 10.04.2018 the authorization (fresh/renewal) under the Bio-Medical Waste Management Rules, 2016 applied by the healthcare facilities upto 20 beds/dental chairs will be granted by the concerned Regional Office within 7 days of receipt of complete application without making inspection of those healthcare facilities. However, the concerned Regional Office shall ensure that no action is pending against the concerned health care facility for violation of the Bio-Medical Waste Management Rules, 2016, Water (Prevention and Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and various rules made there-under. As per the Board’s office order no. 379 dated 27.10.2023, it has been decided that HCFs up to 30 bed capacity, which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plant (STPs) have been installed, shall be granted consents to operate under the Water Act, 1974 and the Air Act, 1981 as well as authorization by PPCB without installation of individual ETP, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the MoEF & CC under BMW Rules, 2016 as amended upto the date and subsequent amendments if any.
The HCF has submitted undertaking regarding date of commissioning on 20/11/2025. (Copy attached)
In this case, the hospital having 10 beds capacity falls within M.C limits of Patiala and the outlet of the HCF is connected to sewer which is further connected to terminal STP.(copy attached)
Keeping in view of above, if approved, the HCF may be granted authorization under Bio-Medical Waste Management Rules, 2016 i.e. upto 19/11/2030 with suitable conditions and with special conditions that:-
1. This BMW authorization is valid for 10 beds capacity only. The HCF will apply for fresh authorization if it installs more beds.
2. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same and intimate to the Board.
3. The HCF shall ensure to comply with the effluent standards as notified under Bio-medical Waste Management Rules, 2016, amended upto date and subsequent amendments if any.
5. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year.
6. There is no claim of continuation of HCF in present premises on the basis of this authorization.
7. The HCF has to comply with the zoning regulation of master plan & to be shifted from the site as and when asked by the Govt./PPCB/ or any concerned Govt. agency.
8. The HCF shall comply with the laws and by laws of Master Plan of Patiala.
9. The hospital shall not carry out any expansion/ modernization/ change in process/ category (from green to orange or to red or so on) or out scale (from small to medium or large) without obtaining prior permission of the Board.
10. In case the HCF is found that it has submitted any wrong/ partial/ forged information/ document or any false affirmation, it shall be liable for action as deemed fit by the Board under the provisions of the Bio-medical waste Rules, 2016.
11. The authorization is being granted without installation of individual ETP, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the MoEF & CC under BMW Rules, 2016 as amended upto the date and subsequent amendments if any. |
