File Note: It is submitted that the hospital has obtained authorization under the Bio-Medical Waste Management Rules, 2016 vide no. BMW/SGR/EE/2016/F dated 17.03.2016 which has been expired on 31.03.2017 for 16 beds capacity. Further, the hospital was visited by the undersigned on 01.10.2025 and during visit, the hospital was found operating without obtaining the consents to operate under the Water Act, 1974, the Air Act, 1981, and also violating the provisions of the Bio-Medical Waste Management Rules, 2016. Accordingly, the hospital was issued show cause notice-cum-personal hearing for violating the provisions of the Water Act, 1974, the Air Act, 1981, and the Bio-Medical Waste Management Rules, 2016 vide Board's letter no. 2266 dated 16.10.2025, before the Environmental Engineer on 17.10.2025 at 02.00 p.m. However, the HCF has neither attended the personal hearing nor given any reply to the show cause notice. Further, the HCF was issued another show cause notice-cum-personal hearing vide Board's letter no. 2301 dated 23.10.2025, before the Environmental Engineer on 29.10.2025 at 02.00 p.m. Dr. Rajiv Gupta, Proprietor of the HCF appeared during the personal hearing and submitted that the HCF has ensured that the hospital shall comply with the observations of the visiting officer and requested to give 15 days time for compliance. After hearing, the representative of the hospital and the officers of the Board, the Environmental Engineer has decided that:- 1. The HCF shall comply with the observations of the visiting officer of the Board, within 15 days. 2. The HCF shall submit agreement with CBWTF for lifting Bio-Medical Waste and will maintain proper record of generation and lifting of bio-medical waste, within 15 days. 3. The HCF shall apply for obtaining renewal of authorization under Bio-Medical Waste Management Rules, 2016 and shall also apply for obtaining consents to operate under the Water Act, 1974 and the Air Act, 1981 within 15 days. 4. AEE-I/JEE-I shall visit the hospital immediately after 15 days to verify the compliance of the decisions of the personal hearing and submit report. Now, the HCF has applied for obtaining fresh authorization under the Bio-Medical Waste Management Rules, 2016 along with requisite documents for 10 beds capacity. The HCF has submitted all requisite documents i.e. approved building plan, Annexure-1, agreement with CBWTF and copy of manifests of lifting of BMW by CBWTF operators. Further, the Board vide its office order no. HQ-3/EPA/2023/2799-2815 dated 19.01.2023, has notified authorization fee for HCFs. In this case, the HCF falls in the category of 01-10 beds capacity and accordingly, as per the latest order of Govt. notification no. STE-STEB010/213/2020-STE(5/4)/485954 dated 06.01.2023 has notified the fee for obtaining authorization under the provisions of the BMW Rules, 2016, which is to be paid by the applicant at the time of submitting the application for obtaining authorization. As the HCF has deposited fee of Rs. 6,000/- vide UTR No. 36843118611DC dated 05.07.2024 under the provisions of BMW Rules, 2016, which is adequate upto 31.12.2025. The brief details of the case applied by the healthcare facility are as under: - 1. The HCF has made an agreement with M/s Medicare Environment Management Pvt. Ltd., Ludhiana valid from 01/11/2025 to 31/10/2030 for 10 bed capacity. 2. The HCF has earlier BMW authorization from 17.03.2016 expired on 31.03.2017 for 16 bed capacity. Accordingly, the HCF was visited by officer of the Board on 26.11.2025. During the visit, it was observed as under: 1. The HCF was found operation. The HCF has removed the 6 no. beds from its premises and now, it is a 10 bedded hospital. 2. The HCF is now segregating Bio-Medical Waste as per the Bio-Medical Waste Management Rules, 2016. Further, the hospital has provided needle shredder and Plastic waste was found cut. 3. The HCF has now provided color coded bins in its premises to collect & segregating the bio-medical waste. Bar code stickers were being used for color coded bags. 4. A storage room has been provided for the storage of bio medical waste, to be lifted by CBWTF, and now, lock & key arrangement has been provided by the HCF. 5. The HCF is now maintaining the records related to the generation, collection, storage, and lifting of the bio-medical waste. 6. The HCF has produced a valid agreement with Medicare Environment Management Pvt. Ltd., Ludhiana valid from 01/11/2025 to 31/10/2030 for 10 bed capacity. It has also produced manifest slips issued by CBWTF for lifting its bio-medical waste. 7. The HCF has provided provision to pre-treat liquid waste with hypo solution before discharged into sewer. 8. The hospital has 01 no. D.G set of capacity 10 KVA equipped with canopy and stack of adequate height. There is 01 another D.G set placed in defunct condition and not in condition of working. As per the latest Office Order of the Board vide no. 379 dated 23/10/2023:- “it has been decided that HCFs upto 30 beds capacity which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal STPs have been installed shall be granted consents to operate and Authorization without installing individual ETPs as an interim arrangement, subject to the condition that HCF shall comply with the effluent standards prescribed by the MOEF&CC under the Bio Medial Waste Management Rules, 2016 as amended from time to time . In the present case, the HCF is located in City Bhawanigarh, where the terminal STP has already been installed and the same is in operation. Moreover, as per the office order no. EPA/2017/No. 5261-86 dated 15/12/2017 the competency of upto 50 beds HCEs and Labs and Blood Banks, Pathological Lab, Veterinary Institutions/Animal House etc. lies with the Environmental Engineer of the Regional Office's. From above, it is evident that the hospital is complying with the Bio-Medical Waste Rules, 2016. Keeping in view of above, if approved, the HCF may be granted authorization under Bio-Medical Waste Management Rules, 2016 granted upto 31.12.2025 with suitable conditions and with special conditions that: - 1. This BMW authorization is valid for 10 beds only. The HCF will apply for fresh authorization if it installs more beds. 2. The HCF will obtain consent to operate under the Water Act (Prevention & Control of Pollution) Act, 1974 and Air (prevention & control of Pollution) Act, 1981, within 15 days. 3. The HCF will renew its agreement with the CBWTF for lifting of its BMW before expiry of the same and intimate to the Board. 4. The HCF will use sodium hypo-chlorite solution for disinfection of chemical liquid waste generated in the HCF and keep the record of the consumption of the Sodium hypochlorite solution. The HCF will comply with general standards for discharge as per BMW Rules, 2016 as amended from time to time. 5. The HCF shall ensure to comply with the effluent standards as notified and Bio-medical Waste Management Rules, 2016, amended upto date and subsequent amendments if any 6. The HCF will submit Annual Report on Bio-Medical Waste Management in Form-IV by 30th June every year. 7. The HCF will maintain proper record of generation and lifting of bio-medical waste. 8. There is no claim of continuation of HCF in present premises on the basis of this authorization. The HCF has to comply with the zoning regulation of master plan & to be shifted from the site as and when asked by the Govt./PPCB/ or any concerned Govt. agency. 9. The HCF shall got lifted/handed over its Bio-Medical Waste generated to the Common Bio-Medical Waste Treatment Facility on daily basis. 10. The HCF shall obtain other statutory approvals required from other departments, if any. Competency EE
