ADDITIONAL INFORMATION IN SPECIFIC CASES. 25 Whether industry is receiving/processing any category of hazardous waste. If yes, give following information. NA 26 Whether industry is selling/ offering to transport/ transporting any category of hazardous waste? If yes, give names & complete correspondence address of the unit to whom the hazardous waste is being sold. No 27 Whether industry is processing imported hazardous waste as raw material? If yes, detail about the permission obtained from MoEF, New Delhi, if any. No It is submitted that the subject cited industry is an waste tyre pyrolysis plant and was granted 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/LDHKH/2025/29154644 dated 29/07/2025 and under Air Act, 1981 vide no. CTOA/Fresh/LDHKH/2025/29145928 dated 29/07/2025, both valid upto 30/09/2029 for manufacturing of Black Oil @ 4000 Kg/day, Black Carbon @ 3400 Kg/day and Steel Wire @ 1400 Kg/day from Waste Rubber@10 TPD with suitable conditions. Further, the as per the directions of the Competent Authority of the Board, the surprise inspection of the industry was conducted by the Officer of the Board on 9.9.2025 and it was observed that the industry was not in operation but the compliance status was thoroughly visited in the presence of representative of the industry. In view of the repeated violations and the adverse observations recorded during the recent site visit by the team constituted by the Board, and in continuation to the earlier notice already issued to the industry vide letter no. 2759 dated 23/07/2021, the matter has been considered by the Competent Authority and it has been decided to initiate action for revocation and cancellation of the consents to operate obtained by the industry and for its closure. Accordingly, show cause notice for revocation of consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and cancellation of consent to operate granted under the Air (Prevention & Control of Pollution) Act, 1981 as well as notice to issue directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with an opportunity of personal hearing before the Chief Environmental Engineer(B) of the Board on 25/09/2025. The representative of the industry attended the hearing and informed that the industry is in process of making compliance of the SOPs laid down by CPCB for tyre pyrolysis units and requested to give one month time for the same. After hearing the representative of the industry, officer of the Board, and material facts on the record, the CEE(B) of the Board decided that:- 1. The industry shall not operate the unit till all compliances w.r.t. SOP issued by CPCB as amended from time to time (Jan, 2024) is made by it. 2. The industry shall make the compliance of the SOPs issued by CPCB as mentioned at Sr. no. 1 above, within one month. 3. The industry shall furnish a bank guarantee amounting to Rs. 5 lakh as an assurance for ensuring continuous compliance with the prescribed environmental norms and the compliance of SOP issued by CPCB for such units within 7 days. 4. Environmental Engineer, Regional Office, Fatehgarh Sahib shall visit the industry on weekly basis to ensure that the industry is not being operated without making compliance of the SOPs and if found violating, shall submit the report with recommendations, immediately. 5. The industry shall be re-visited by the same team, which earlier visited the unit i.e. Er. Gurjeet Kaur, EE to check the compliance made by the unit w.r.t. adoption of SOP issued by the CPCB (Jan, 2024), after one month and submit the report to Sr. Environmental Engineer, Zonal Office-II, Patiala. 6. The matter shall be re-heard upon receipt of the compliance verification report from the team mentioned at Sr. no. 4 above. If approved, the proceedings may be conveyed to the industry and Regional Office as well as SEE(HQ-3) and EE(HQ-3/2) for ensuring compliance, please. Now, in compliance w.r.t. the SOP’s, the industry has applied to obtain fresh authorization under the provisions of the Hazardous Waste Management Rules, 2016 for Cat. No. 5.1 @ 0.01 TPA, Cat. No. 5.2 @ 0.180 TPA and Cat. No. 35.3 @ 0.480 TPA from the Board. Agreement for Category 5.1: The industry has submitted the agreement executed with M/s Satkar Oil CO. D-177, Focal Point, Ludhiana for lifting of its hazardous waste of category 5.1. dated 27.09.2025 valid upto 27.08.2027. Agreement for Category 5.2 : The industry has executed an agreement with M/s Nimbua Green Filed Pvt. Ltd. for lifting of its hazardous waste of category 5.2 vide no. NGPA/F&F/2K25-2K26/1723 dated 14.11.2025. Agreement for Category 35.3: The industry has executed an agreement with M/s Nimbua Green Filed Pvt. Ltd. for lifting of its hazardous waste of category 35.3 vide no. NGPA/F&F/2K25-2K26/1723 dated 14.11.2025. In, incompliance to point no. 4 of the personal hearing, the industry was visited by the undersigned on 02.12.2025 and Sh. Mehak Puri (Representative) was contacted. During visit, it was observed as under: 1. The industry was not in operation due to shortage of raw material. 2. The industry has installed 02 nos. reactors of capacity 5 T/batch each. The industry has provided wood fired furnaces for startup/ initial heating of reactors. 3. The industry has provided common wet scrubber followed by alkali scrubber as APCD. 4. The industry has provided separate energy-meter with APCD & is maintaining record of same. 5. The stack emission sampling could not be conducted as the unit was not in operation. 6. The industry has provided flare stack for venting of excess gas generated from the reactors. 7. The industry has installed 01 no. DG set of capacity 25 KVA, which is equipped with canopy and stack of adequate height. 8. The industry has installed 01 no. submersible pump and the water meter has also provided on it. 9. The industry has provided septic tank for the treatment of domestic wastewater and the same is being disposed off onto land for plantation within the premises of the unit after passing through septic tanks. 10. The industry has installed 1 no. water tank with recycling arrangement for cooling purpose. 11. The industry has installed an ETP which will be commissioned within a week’s time. 12. The industry has provided separate impervious closed room for storage of hazardous waste of various categories. Accordingly, the industry is in process of completing the compliance w.r.t the SOP issued and is to be re-visited by the same team, which earlier visited the unit i.e. Er. Gurjeet Kaur, EE to check the compliance made by the unit w.r.t. adoption of SOP issued by the CPCB (Jan, 2024). From above, it is clear that the industry has made efforts to comply with the SOP’s laid down by the CPCB for such type of units. In view of above and to further help the industry to submit compliance of the SOP’s, it is recommended that case of the industry for obtaining fresh authorization under HOWM Rules, 2016 for generation, collection & storage of hazardous waste of Cat. No. 5.1 @ 0.01 TPA, Cat. No. 5.2 @ 0.180 TPA, and Cat. No. 35.3 @ 0.480 TPA may kindly be considered for grant of authorization upto 30.09.2030 (in consonance with the air consent) subject to the suitable conditions and additional conditions as under: 1) The industry shall not operate its units without obtaining prior permission of the Board. 2) The industry shall dispose off its Hazardous waste to the authorized recycler / re- processor having valid Registration Certificate-cum-Pass Book from Punjab Pollution Control Board and valid authorization of the Board under the said Rules and 'consents to operate' under the Water Act, 1974 and the Air Act, 1981. 3) The industry shall handle the Hazardous Waste(s) strictly in accordance with the provisions of the Hazardous & Other Wastes (Management and Transboundary Movement) Rules, 2016 and guidelines issued by Central Pollution Control Board/Ministry of Environment & Forests and Climate Change, New Delhi. 4) The occupier generating hazardous waste/operator of a facility for collection and storage of hazardous waste shall maintain records of such operations in Form-3. 5) The occupier/operator of a facility shall send annual returns to the Board in form-4 on or before 30th day of the June following to the financial year to which that return relates. 6) The Authorized person shall report, about the accident which occurs at the hazardous waste storage/treatment site immediately to the Board. 7) An occupier who is generating hazardous waste shall store his waste category wise on site in environmentally sound manner till its treatment. 8) An occupier /generator shall not store hazardous wastes in open ground. It must be stored in an isolated site away from plant operational area. 9) The storage tank/container of the hazardous wastes should be in good condition and made of (or lined with) an appropriate material which does not react with the waste contained in it and can withstand the physical and environment conditions during storage and handling. 10) The occupier generating hazardous waste shall mark each container holding hazardous waste with the marking ''HAZARDOUS WASTE'' both in English and Punjabi. 11) The storage area should be fenced properly and a sign Board indicating ''DANGER'' and 'HAZARDOUS WASTE' sign & nature of the waste shall be placed at storage site. 12) The occupier generating hazardous waste shall provide the required safety devices like safety mask, goggles, hand-gloves, gum boots etc to the workers for handling the hazardous waste. The occupier shall impart training to the personnel/workers for handling and storage of hazardous wastes. 13) There should be sufficient & efficient provisions to avoid under ground water contamination from waste storage of hazardous wastes 14) The industry shall take steps wherever feasible, for reduction in hazardous waste generated or recycled or reused. 15) Non compatible hazardous waste and material shall not be mixed in the same storage container. 16) Packaging, Labelling of Used/Waste oil shall be in accordance with the provisions of the rules made by the Central Government under the Motor Vehicles Act, 1988 and other guidelines issued from time to time.
