Subject – Show cause notice for refusal of consent to operate under the Water ( Prevention & Control of Pollution) Act 1974 and the Air ( Prevention & Control of Pollution) Act, 1988.
( CTO - Air & Water case of M/s Maxxon Space Builders, Project : Maxxon Celebration, Zirakpur)
Reference – Notice No. 1539 dated 03-03-2023 & Board’s clarification dated 15-02-2023.
Respected Sir,
In reply to Notice & Board’s clarification received as above, we would like to submit that there were some health issues which resulted in delay in replying the observations raised and we regret the same. Our point wise reply to the observations is as under:
POINT WISE REPLY IS AS UNDER:
1) In the layout plan approved by the authority, the location of the STP has not been marked. Further, in the layout plan submitted with the application, no detail regarding no. of SCOs , offices & halls to be constructed has been mentioned. Hence, the approved layout plan mentioning complete details is required to be uploaded.
STP HAS BEEN INSTALLED IN THE BASEMENT AREA AND SAME HAS BEEN VERIFIED BY VISTING OFFICER ALSO. THE SAME WILL BE PROJECTED IN COMPLETION DRAWINGS OF THE PROJECT. DETAILS REGARDING SHOWRROMS/OFFICES ON EACH FLOOR ARE BEING SUBMITTED IN SEPARATE EXCEL SHEET. ALSO THAT COMPLETE APPROVED LAYOUT PLAN WITH ALL FOOORS HAS BEEN ANNEXED ALONG WITH A SEPARATE EXCEL SHEET SHOWING AREA DETAILS ON EACH FLOOR.
2) The DG set for which the Consent to Operate has been applied has not been installed at the site. The project proponent has installed 2 no. temporary DG set of capacity 62.5 KVA with canopy and adequate stack and 45 KVA without canopy and inadequate stack height.
DG SETS OF SMALL CAPACITIES ARE TEMPORARILY INSTALLED TO RUN THE MAKE SHIFT OFFICE OF THE BUILDER WITHIN THE PROJECT AND TO CARRY THE FINISHING JOBS OF THE PROJECT. WORK ORDERS FOR FINAL DG SETS HAVE BEEN PLACED ( COPIES ANNEXED) AND WILL BE INSTALLED SOON, WELL BEFORE COMPLETION OF THE PROJECT AND OFFERING ANY OCCUPANCY WITHIN THE PROJECT.
3) The dimensional drawing of STP submitted is not proper as it not clearly depicts all the components of the STP.
DIMENSIONAL DRAWING UPLOADED PLEASE.
4) The project proponent has not developed the plantation area and karnal technology (@ 0.75 acres) where it is proposing to use the treated waste-water @ 13 KLD.
PLANTATION AS PER KARNAL TECHNOLOGY HAS BEEN DONE IN THE LAND ADJOINING THE PROJECT (PICTURES ANNEXED).
5) The project proponent has not carried out color coding of the pipeline laid for fresh water, dual plumbing etc.
SITE PLAN WITH SERVICES IN COLOUR CODING UPLOADED PLEASE.
6) The project proponent has not obtained permission from PWRDA for ground water abstraction till date.
PWRDA APPLICATION FILED AND COPY OF SAME ANNEXED PLEASE.
7) The project proponent has not installed colour coded bins at the site for promoting segregation of solid waste in compliance of NOC conditions.
BINS FOR SEGRAGATED WASTE HAS BEEN PLACED AT SITE.
8) The project proponent has not installed mechanical composter at the site for in-situ management of wet solid waste.
INITIALLY DUE TO VERY LESS OCCUPANCY AND FOR SITE YET TO BE OPERATIONAL, BINS HAS BEEN PLACED AND ONCE SUBSTANTIAL OCCUPANCY IS THERE, MECHANICAL COMPOSTER WILL BE INSTALLED. WORK ODER FOR PURCHASE OF MECHANICAL COMPOSTER ALREADY RELEASED AND COPY OF THE SAME ANNEXED PLEASE.
9) The project proponent is required to deposit NOC regularization fee of Rs 1800/- for increase in assets by Rs 14 Lacs.
ADDITIONAL FEE DEPOSITED PLEASE.
10) The project proponent is yet to make connection of the treated water line from STP to plantation and dual plumbing.
NEEDFUL DONE PLEASE.
11) The project proponent is required to submit component wise calculation of built up area of 17879 sqmt as mentioned in the application form.
EXCEL SHEET FOR THE SAME ANNEXED PLEASE.
12) The project proponent has installed 2 borewells at the site but no water meter has been provided.
WATER METER INSTALLED AT SITE PLEASE.
Above is our reply to the observations raised by the Board, We had tried to attend all the observations in genuine manner with pictures and documentary proof of the same. Requested to please grant CTO(Water) & CTO (Air) for the Project.

REPLY TO OBSERVATIONS
Point wise reply to the Observations raised is as under :
1. The project proponent has not linked consent fees with the application under Water Act, 1974 and Air Act, 1981.
FEE LINKED PLEASE.
2. The project proponent is required to deposit NOC regularization amounting to Rs 2900/- for increase in assets amounting to Rs 42 Lakh.
RS. 2900.00 DEPOSITED PLEASE.
3. The project proponent was granted Consent to Establish under the provision of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for installation of STP of capacity 20 KLD based on SAF technology. Now the project proponent has applied for fresh Consent to Operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for installation of STP of capacity of 50 KLD based on MBR technology.
INITIALLY AND AS PER DESIGN PARAMETERS, STP OF CAPACITY 20 KLD WITH SAFF TECHNOLOGY WAS RECOMMENDED BUT LATER ON DUE TO ANTICIPATED ADDITONAL LOAD OF EATERIES/FOODCOURTS, STP OF CAPACITY 50 KLD WAS INSTALLED. AS THE SPACE DESIGNATED FOR STP WAS ACCORDING TO 20 KLD PLANT AND DUE TO INCREASED CAPACITY AND SIZE (50 KLD) AND LESS SPACE AVAILABLE, MBR TECHNOLOGY WAS PREFERRED FOR ITS COMPACT DESIGN. IT IS ENSURED THAT THERE WILL BE NO EFFECT ON RESULTS OF TREATED WATER DUE TO THUS CHANGE AND ALL PPCB NORMS WILL BE FOLLOWED STRICTLY.
4. The project proponent has submitted letter of MC Zirakpur dated 18.10.21 regarding disposal of 6.48 KLD treated waste-water into MC sewer subject to deposition of charges and capacity of sewer available at that time. Hence, it is requested to submit latest clearance letter of MC sewer regarding release of sewer connection to the project for 6.48 KLD treated sewer.
KEEPING IN VIEW THE LACK OF ADEQUATE STP CAPACITY OF MC ZIRAKPUR AT PRESENT. WE WILL DISPOSE OFF OUR SURPLUS TREATED WATER INTO VACANT LAND FOR PLANTATION AS PER KARNAL TECHNOLOGY. THIS LAND IS OWNED BY THIS SAME GROUP M/S KRISHANG BUIDTECH PVT LTD. AND IS IN BALAUNGI, DISTT SAS NAGAR, HARDLY 15 KM FROM PROJECT SITE. THE TRANSPORTATION WILL BE DONE THROUGH 10 NO. MOBILE TANKERS ALREADY PLANNED TO BE HIRED FOR THIS PURPOSE. A SEPARATE RESOLUTION OF COMPANY DIRECTORS IN THIS RESPECT IS ANNEXED PLEASE.
5. The project proponent is required to submit floor wise plan clearly showing the details of 69 Showrooms and 12 shops & mentioning built up area of project, for which it is applying for Consent to Operate.
NEEDFUL DONE PLEASE.
6. The project proponent in the feasibility report submitted along with NOC application has calculated population taking 5 person per SCO and show room but the calculation done is not right as the project proponent has also proposed restaurant and food court within its project as per information given during visit.
AMENDED FEASIBILITY REPORT ALONG WITH CALCULATION DETAILS COVERED IN IT, ANNEXED PLEASE.
REQUESTED TO PLEASE CONSIDER ABOVE AS OUR REPLY TO THE OBSERVATIONS RAISED BY BOARD FOR EARLY GRANT OF CTOs & DELAY IN REPLY IS DEEPLY REGRETTED.
