Subject: Show cause notice for refusal of consent under the Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974.
Whereas, it is mandatory on the part of industry to obtain the 'consent to operate' under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 for discharge of effluent/emissions from its industrial premises and to operate an industrial plant.
And whereas it is also mandatory on the part of industry to install proper and adequate effluent /air pollution control devices so that the concentration of various pollutants conforms to the effluent/ emission standards prescribed by the Board.
And whereas, the industry was granted consent to operate under Water Act, 1974 vide no. ROJ/JAL/W/F-200 dated 19.12.2015 under Air Act, 1981 vide no. ROJ/JAL/APC/F-385 dated 19.12.2015, which were valid upto 18.12.2015 under green category.
And whereas, the industry has applied consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and same was returned with the observations that the industry will apply for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under red category as decided by Competent Authority of the Board.
And whereas, the industry has applied for renewal of consent to operate under Water Act, 1974 and Air Act, 1981under red category through OCMMS.
And whereas, the industry was visited by AEE of Regional Office on 09.01.2018 and it was observed that the industry was in operation during visit and is engaged in process of PVC coated textile fabric. The industry has installed one thermopack of capacity 10 lac kcal with dust collector as APCD. Wood was using as fuel and same was in operation during the visit. However the industry has not installed the sampling point & platform with it. The industry has also installed oven system with stacks at site. The industry has installed one DG set of capacity 320 KVA, which is with canopy. The industry has not provided the septic tank for its domestic effluent, it has provided only small underground concrete tank from where effluent is directly disposed off onto land for plantation. The industry has not submitted DTP certificate regarding classification area and not installed sample collection arrangement for collection of sample.
And whereas, the industry is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
And whereas, the matter has been considered by the Competent Authority and it has been decided to issue show cause notice for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, with an opportunity of show cause notice.
As such, the industry is hereby given an opportunity, to file objections, if any, within 15 days, as to why the proposed action be taken, failing which it will be presumed that the industry has nothing to say and the Board shall go ahead, to take proposed action for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 without giving any further notice / opportunity.
