Subject : Show cause notice for refusal of consent to operate u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987.
Whereas it is obligatory on the part of industry to obtain the 'consent to operate' of the Board u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 for discharge of emission from its industrial premises and to operate an outlet.
And whereas, it is mandatory on the part of industry to install proper and adequate Air Pollution Control Device so that the concentration of various pollutants conforms to the emission standards prescribed by the Board.
And whereas, the industry was granted consent to operate under Air (Prevention & Control of Pollution) Act, 1981, which is valid upto 31.03.2018.
And whereas, industry has applied for consent to operate under Air (Prevention & Control of Pollution) Act, 1981 through OCMMS.
And whereas, the industry was visited by AEE on 16.03.2018 and observed as under:-
1) Sh. P.S. Nanda representative of the industry was contacted at site.
2) The industry has installed 04 No. Shot blasting machines with separate dust collector as APCD with separate stack. During visit, no shot blasting machine was in operation.
3) The industry has installed 04 No. Hammers machines. During visit, ROF fuel was being used in its furnace. The industry has also installed 03 No. Forging furnaces. Furnace oil was being used as fuel in it.
4) The industry has also installed 02 No. Presses, 02 No. Heating furnace with separate stack.
5) The industry has installed 03 DG Sets of capacity 1010 KVA, 500 KVA & 320 KVA with canopy and adequate stack height. ..
And whereas, uploaded C.A certificate does not contain the value of plant & machineries and other fixes assets as on date. However, the industry has not submitted the separate value of plant & machinery. The industry has not uploaded the approved building plan only forwarding letter of the authority submitted. The industry has not installed any rain water harvesting system in the premises and the runoff water of the premises is discharged onto green belts and lawn area within the premises. The cost of plant and machinery mentioned is Rs. 20,37,42,7016 on incorrect as compare to total cost which is entered by mistake by the industry and the actual cost of plant and machinery is Rs. 136.75 Crores, however C.A certificate showing the value of Rs. 136.75 Crores including other fixed assets not submitted.
And whereas, the industry is violations of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987.
And whereas, it has now been proposed to refuse the consent to operate applied by the industry under the Air (Prevention & Control of Pollution) Act, 1981, as amended in 1987, after affording an opportunity.
As such, the industry is hereby given an opportunity, to file objections, if any, within 15 days, as to why the consent may not be refused, failing which it will be presumed that the industry has nothing to say and the Board shall go ahead, to take proposed action under the Air (Prevention & Control of Pollution) Act, 1981 without giving any further notice / opportunity.
