19589488 false true Sub: Show Cause Notice for refusal of Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Whereas, it is mandatory on the part of each and every industry to obtain the consent of the Board u/s 21 of Air Act, 1981 & 25/26 of the Water Act, 1974 to operate an industrial plant and to discharge its emissions & trade of sewage effluent. And whereas, it is also mandatory on the part of each and every industry to install adequate and appropriate air pollution control device so that the air emissions & concentration of pollutants in the trade on sewage effluent discharged by the industry do not contain any air pollution in excess of the standards laid down by the Board. The industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974. The industry was visited by the officer of the Board on 26.07.2022 and found as under:- 1. The industry was in operation during visit and engaged in the manufacturing of Industrial packing material @ 200 Kg/day by using of Fresh Granules @ 200 Kg/day, Polyester Roll @ 60 Kgs/day, L.D Roll @ 80 Kgs/day, Ink @ 32 Kgs/day and P.P Roll @ 32 kgs/day. 2. The industry has installed 1 offset printing machine and 3 nos. cutting machines. 3. The industry has also installed 1 no. extruder machine. 4. The industry is manufacturing packing material which is used for packing of different food items eg. Bread, pulses and other eatables. 5. The industry has installed 1 D.G. set which is equipped with canopy but without stack of adequate height. 6. There is no generation of trade effluent from industry, only domestic effluent is generated, which is discharged into MC sewer. 7. The industry has not obtained registration under Plastic Waste Management Rules, 2016. 8. The industry has also not applied for authorization under Hazardous Waste Management Rules, 2016 for all applicable categories. Perusal of above reveals that the industry is not complying with the provision of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. And whereas it has now been decided to refuse the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. And whereas, before initiating proposed action under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 applied by the industry, an opportunity to Show Cause in writing has been afforded to explain as to why consents applied by the industry may not be refused. As such you are hereby given an opportunity to Show Cause in writing with 07 days as to why the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 applied by the industry may not be refused.
