Subject: Show cause notice for refusal of consent under the Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974.
Whereas, it is mandatory on the part of industry to obtain the 'consent to operate' under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 for discharge of effluent/emissions from its industrial premises and to operate an industrial plant.
And whereas it is also mandatory on the part of industry to install proper and adequate effluent /air pollution control devices so that the concentration of various pollutants conforms to the effluent/ emission standards prescribed by the Board.
And whereas, the industry was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 which are valid upto 30.06.2018.
And whereas, the industry has applied for renewal consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act 1981 through OCMMS of the Board.
And whereas, the industry was visited by officers of the Board on 23.01.2018 and during visit the industry was in operation and one air emission sample was collected from the stack attached with the induction furnace of capacity @ 150 kg/heat and after APCD i.e bag filter house and as per analysis report the concentration of SPM is found 86 mg/nm3 which is found within the prescribed limits of the Board. .
And whereas, the industry was visited by AEE on 13.02.2018 and it was observed that the industry was in operation during visit and is engaged in process of manufacturing of S.S casting and valves @ 7 MTD. The industry was engaged in the process of electroplating at site and same was in in operation. The industry has provided underground plastic storage tank of capacity approx. 2000 ltrs for the collection of its electroplating effluent generated at site. The industry has got shifted its trade effluent to M/s JBR Tech. Pvt Ltd Ludhiana @ 1000 ltr on 01.02.2018. The industry has not uploaded the approved building plan , classification of land use pattern The industry has installed 2 no. Induction furnace of capacity 300 kg and 150 kg per/heat with common bag filter house as APCD. Out of which only one induction furnace of capacity 150 kg was in operation.
And whereas, the industry is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
And whereas, the matter has been considered by the Competent Authority and it has been decided to issue show cause notice for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, with an opportunity of show cause notice.
As such, the industry is hereby given an opportunity, to file objections, if any, within 15 days, as to why the proposed action be taken, failing which it will be presumed that the industry has nothing to say and the Board shall go ahead, to take proposed action for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 without giving any further notice / opportunity.
