Subject: Show cause notice for refusal of consent under the Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974.
Whereas, it is mandatory on the part of industry to obtain the 'consent to operate' under Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 for discharge of effluent/emissions from its industrial premises and to operate an industrial plant.
And whereas it is also mandatory on the part of industry to install proper and adequate effluent /air pollution control devices so that the concentration of various pollutants conforms to the effluent/ emission standards prescribed by the Board.
And whereas, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act 1981.
And whereas, the industry was visited by AEE of Regional office on 03.02.2018 and observed that the industry was not in operation during the visit, however it is engaged in manufacturing of glue from mixing of formaldehyde, caustic and urea as raw material. The industry has installed 3 no. kettles for mixing, 1 no. wood fired baby boiler and 1 no. DG set without canopy. The industry has made arrangement for re-circulation of waste water back in process. The industry is discharging its domestic effluent onto land for plantation after septic tanks. The industry has not submitted the classification of area, the usage of urea make and certificate from CGWA as it is commissioned in May 2017. The industry has been established in May/2017 in the plot of M/s Supreme Rice Mills which has been closed now.
And whereas, the industry is violating various provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
And whereas, the matter has been considered by the Competent Authority and it has been decided to issue show cause notice for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, with an opportunity of show cause notice.
As such, the industry is hereby given an opportunity, to file objections, if any, within 15 days, as to why the proposed action be taken, failing which it will be presumed that the industry has nothing to say and the Board shall go ahead, to take proposed action for refuse the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 without giving any further notice / opportunity.
